【摘要】： 美國的知識(shí)產(chǎn)權(quán)反壟斷法制定及實(shí)行已經(jīng)有一百二十年的歷史,形成了眾多的經(jīng)典案例,也積累了大量的成功經(jīng)驗(yàn)。美國在立法、執(zhí)法及司法實(shí)踐中對(duì)知識(shí)產(chǎn)權(quán)反壟斷法不斷調(diào)整和完善以促進(jìn)(技術(shù)和制度)創(chuàng)新,維護(hù)市場競爭秩序,最終達(dá)到維護(hù)它最根本的市場經(jīng)濟(jì)體制的目的。而政策目標(biāo)在美國知識(shí)產(chǎn)權(quán)反壟斷法的立法、執(zhí)法及司法實(shí)踐中發(fā)揮了靈魂性的導(dǎo)向作用。因此要對(duì)美國知識(shí)產(chǎn)權(quán)反壟斷法做深入的研究必須對(duì)其政策目標(biāo)有一個(gè)深刻的了解與把握。 本文按照從宏觀到微觀的研究順序共分為四大部分。第一部分為導(dǎo)論,主要討論了國內(nèi)外研究綜述、研究方法和研究框架；第二部分是對(duì)知識(shí)產(chǎn)權(quán)反壟斷法的基礎(chǔ)理論研究。該部分首先介紹了知識(shí)產(chǎn)權(quán)反壟斷法涵義與基本屬性,其次闡述了知識(shí)產(chǎn)權(quán)反壟斷法的理論依據(jù),接著對(duì)知識(shí)產(chǎn)權(quán)反壟斷法政策目標(biāo)作了一個(gè)系統(tǒng)的分類,最后論述了知識(shí)產(chǎn)權(quán)反壟斷法政策目標(biāo)的重要意義；第三部分是本文的主要部分,在這一部分中,本文首先指出美國知識(shí)產(chǎn)權(quán)反壟斷法政策目標(biāo)主要是促進(jìn)創(chuàng)新和維護(hù)競爭,然后把美國知識(shí)產(chǎn)權(quán)反壟斷法政策目標(biāo)演變分為三個(gè)階段,詳細(xì)地分析了美國知識(shí)產(chǎn)權(quán)反壟斷法政策目標(biāo)定位與調(diào)整的宏觀經(jīng)濟(jì)背景、各方面深層次的原因及在立法、司法及執(zhí)法實(shí)踐中的體現(xiàn)(暨對(duì)社會(huì)起到的作用)；第四部分,美國知識(shí)產(chǎn)權(quán)反壟斷法政策目標(biāo)的啟示。
[Abstract]:The American intellectual property Rights Anti-monopoly Law has been enacted and implemented for 120 years, forming many classic cases and accumulating a great deal of successful experience. In law enforcement and judicial practice, the anti-monopoly law on intellectual property has been constantly adjusted and perfected to promote (technical and institutional) innovation and to maintain the order of market competition. Ultimately achieving the goal of safeguarding its most fundamental market economy system. And the policy objective is to legislate against monopoly law on intellectual property in the United States. Law enforcement and judicial practice have played a guiding role in the soul, so to do in-depth research on American intellectual property rights anti-monopoly law, we must have a profound understanding and grasp of its policy objectives. This paper is divided into four parts according to the order of research from macro to micro. The first part is the introduction, mainly discusses the domestic and foreign research review, research methods and research framework; The second part is the basic theory research of intellectual property right anti-monopoly law. This part introduces the meaning and basic attribute of intellectual property right anti-monopoly law, and then expounds the theoretical basis of intellectual property right anti-monopoly law. This paper first points out that the main goal of American intellectual property anti-monopoly law policy is to promote innovation and maintain competition, and then divides the evolution of American intellectual property rights anti-monopoly law policy into three stages. This paper analyzes in detail the macro-economic background of the orientation and adjustment of American intellectual property rights antimonopoly law policy, the deep-seated reasons in various aspects and its embodiment in the practice of legislation, judicature and law enforcement (and the role it plays in society; part 4th). The enlightenment of American intellectual property right anti-monopoly law policy goal.
