【摘要】：立法法理學(xué)是針對(duì)傳統(tǒng)司法法理學(xué)而提出的研究立法的新的理論進(jìn)路,法律及其與政治的關(guān)系是理解立法法理學(xué)內(nèi)在邏輯的核心鏈條。自由是立法法理學(xué)的微觀基礎(chǔ),政治的環(huán)境則是其宏觀背景。立法法理學(xué)應(yīng)當(dāng)在實(shí)踐哲學(xué)的框架內(nèi)進(jìn)行把握,即一方面要重視實(shí)踐理性在立法過(guò)程中的作用,使立法者遵循立法法理學(xué)的原則、遵守立法者的義務(wù);另一方面則要認(rèn)識(shí)到德性標(biāo)準(zhǔn)在選舉立法者中的重要地位,重視立法者自身德性的培養(yǎng),特別是立法智慧的培養(yǎng)。前者是"規(guī)則主義"的立法法理學(xué),后者則是德性主義的立法法理學(xué),二者共同構(gòu)成立法法理學(xué)的完整圖貌,不可偏廢其一。
[Abstract]:Legislative jurisprudence is a new theoretical approach to the study of legislation in view of traditional judicial jurisprudence. The relationship between law and politics is the core chain of understanding the internal logic of legislative jurisprudence, and freedom is the micro basis of legislative jurisprudence. The political environment is its macro background. Legislative jurisprudence should be grasped within the framework of practical philosophy, that is, on the one hand, we should attach importance to the role of practical rationality in the legislative process, so that legislators follow the principles of legislative jurisprudence. Compliance with the obligations of legislators; On the other hand, we should recognize the important position of moral standards in the election legislators, and attach importance to the cultivation of legislators' own virtue, especially the cultivation of legislative wisdom. The former is the legislative jurisprudence of "rulesism". The latter is the legislative jurisprudence of virtue, both of which constitute a complete picture of legislative jurisprudence.
