【摘要】：法治評估不是簡單地對法治發(fā)展的各個方面進行量化處理,首先要解決的是對有著不同社會結構、處在不同社會發(fā)展水平的國家或地區(qū)按照統(tǒng)一標準進行法治評估的可能性問題。法治包含規(guī)則之治、平等實施和良法之治幾種不同的含義,但每種含義都受制于一定的社會條件,需要類型化處理。"規(guī)則之治"有賴于社會的穩(wěn)定程度,對迅速變化的社會沒有實質意義。平等實施有賴于法律資源的充分性,在缺乏人力、物力、財力保證的情況下很難做到平等實施,而需要尋找成本低、替代性的措施和適合本地特點的方式。良法之治有賴于對什么是良法達成共識,不能以一種模式為基礎來評估其他模式法治發(fā)展程度。法治評估必須注意各國治理結構的差別,一個國家用法律解決的問題,另一個國家可能用非法律的方法解決。
[Abstract]:The rule of law evaluation is not simply to quantify the various aspects of the development of rule of law. First, we need to solve the possibility of rule by law in accordance with the unified standard of countries or regions with different social structures and different levels of social development. The rule of law includes the rule of good law, equality and the implementation of several different meanings, but each meaning is subject to certain social conditions, type of treatment need. The rule of rule depends on the stability of the society and has no substantial significance to the rapidly changing society. Equal implementation depends on the adequacy of legal resources. It is difficult to achieve equality in the absence of human resources, material resources and financial guarantee. Instead, we need to find low cost, alternative measures and local characteristics. Good governance depends on what is good not to reach a consensus, a model based assessment model of rule of law development degree. The evaluation of the rule of law must pay attention to the differences in the governance structure of each country, the problem that one country solves by law, and the other country may be solved by non legal method.
