【摘要】：誹謗法中的抗辯事由發(fā)揮著調(diào)和名譽(yù)權(quán)和表達(dá)自由、保護(hù)沖突的重要功能。為了適應(yīng)新時(shí)代表達(dá)自由的保護(hù)要求,2013年英國(guó)通過(guò)了誹謗法修正案,而抗辯事由的成文化和體系化是其重要內(nèi)容。新誹謗法設(shè)專章規(guī)定"抗辯",將存在于普通法中的正當(dāng)化事由、公正評(píng)論、雷諾茲特權(quán)等抗辯事由成文化并賦予新的內(nèi)涵,擴(kuò)大了1996年誹謗法免責(zé)特權(quán)的適用范圍,并增加了兩種新的抗辯事由。英國(guó)誹謗法形成了包括真實(shí)性、誠(chéng)實(shí)觀點(diǎn)、公共利益、網(wǎng)絡(luò)運(yùn)營(yíng)者抗辯、學(xué)術(shù)評(píng)論抗辯以及報(bào)道免責(zé)特權(quán)六種抗辯事由的完整體系。
[Abstract]:The defenses in the law of defamation play an important role in reconciling the right of reputation and freedom of expression and protecting the conflict. In order to adapt to the protection requirements of freedom of expression in the new era, the libel Amendment Act was adopted in Britain in 2013, and the culture and systematization of the reasons for the defense is an important part. The new law of defamation provisions set "defense", will exist in the common law of justification, fair comment, Reynolds privileges and other defenses into culture and gives the new connotation, expanded the scope of the 1996 libel law privileges, and adds two new things by defense. The British libel law has formed six systems of defense, including authenticity, honesty, public interest, network operator's defense, academic review, and reporting privilege.
