【摘要】：為確定污染源、污染范圍和污染程度,鑒定民事責(zé)任訴訟請(qǐng)求與海洋工程建設(shè)項(xiàng)目所產(chǎn)生的環(huán)境影響之間有無因果關(guān)系,根據(jù)《海水水質(zhì)標(biāo)準(zhǔn)》、《漁業(yè)水質(zhì)標(biāo)準(zhǔn)》、《海洋沉積物質(zhì)量》和《海洋生物質(zhì)量》等國家標(biāo)準(zhǔn)對(duì)海洋工程建設(shè)項(xiàng)目所在的養(yǎng)殖海域水質(zhì)、沉積物、生物體選點(diǎn)采樣,實(shí)地勘察,進(jìn)行環(huán)境監(jiān)測(cè)和環(huán)境影響評(píng)價(jià)。結(jié)果表明,水質(zhì)污染物、沉積物污染物,生物體污染物不是民事責(zé)任訴訟請(qǐng)求所述養(yǎng)殖貝類大量死亡的直接原因。司法鑒定結(jié)論:海洋工程建設(shè)項(xiàng)目施工現(xiàn)場(chǎng),周圍海域局部受到施工產(chǎn)生較小泥漿入海泥沙影響,靠近海洋工程建設(shè)項(xiàng)目施工現(xiàn)場(chǎng)的一定范圍養(yǎng)殖貝類死亡與海洋工程建設(shè)項(xiàng)目施工之間有因果關(guān)系,依據(jù)水域污染事故漁業(yè)損失計(jì)算方法,評(píng)估養(yǎng)殖損失。
[Abstract]:In order to determine the pollution source, pollution scope and pollution degree, and to identify whether there is a causal relationship between the claim for civil liability and the environmental impact caused by the marine engineering construction project, according to the National Standards of seawater quality Standard, Fisheries quality Standard, Marine sediment quality and Marine Life quality, the water quality, sediment and biological selection points of the marine engineering construction projects are sampled and investigated on the spot, Conduct environmental monitoring and environmental impact assessment. The results show that water quality pollutants, sediment pollutants and biological pollutants are not the direct causes of a large number of deaths of cultured shellfish mentioned in the civil liability claim. The conclusion of judicial appraisal: at the construction site of marine engineering construction project, the surrounding sea area is affected by the small mud entering the sea and sediment, and there is a causal relationship between the death of cultured shellfish near the construction site of marine engineering construction project and the construction of marine engineering construction project. According to the calculation method of fishery loss of water pollution accident, the aquaculture loss is evaluated.
