論改革和完善政府收容教養(yǎng)制度執(zhí)行方式

【摘要】: 本文以目前政府收容教養(yǎng)制度的執(zhí)行方式和政府收容教養(yǎng)少年的矯治模式為切入點,與未成年勞動教養(yǎng)人員相比較,針對政府收容教養(yǎng)制度在執(zhí)行過程中的混亂局面,結(jié)合筆者在司法實踐工作中的親身體會,闡述兩種制度適用對象在自然屬性、法律屬性、社會屬性等相異之處,檢視當前兩種制度在執(zhí)行過程中的無區(qū)別對待帶來的弊端,進而就政府收容教養(yǎng)制度執(zhí)行方式和政府收容教養(yǎng)少年矯治模式提出基本設(shè)想。本文引言部分簡要介紹了當前政府收容教養(yǎng)制度的研究現(xiàn)狀,第一部分致力于厘清政府收容教養(yǎng)制度與勞動教養(yǎng)制度、政府收容教養(yǎng)少年與未成年勞動教養(yǎng)人員的概念、性質(zhì)、適用對象。第二部分回顧了政府收容教養(yǎng)少年、未成年勞動教養(yǎng)人員執(zhí)行機構(gòu)的沿革,指出當前執(zhí)行環(huán)節(jié)對兩種制度、兩個群體一體化對待的司法現(xiàn)狀。第三部分從生理學、社會學、法學以及矯治實踐等角度論述政府收容教養(yǎng)少年與未成年勞動教養(yǎng)人員之間的差異,繼而指出兩者應(yīng)區(qū)別對待。第四、第五部分從司法實踐者的角度介紹當前對未成年勞動教養(yǎng)人員、政府收容教養(yǎng)少年實施的管理、教育、生活衛(wèi)生模式,以及該模式在確立司法制度權(quán)威性、維護違法犯罪少年身心健康、維護違法犯罪少年合法權(quán)益、提高教育矯治質(zhì)量等方面顯露的弊端。第六部分對政府收容教養(yǎng)制度的具體執(zhí)行方式提出構(gòu)想,通過設(shè)立少年教養(yǎng)院、改造工讀學校、實施家中監(jiān)禁、設(shè)立養(yǎng)育家庭等社區(qū)矯正項目,減少監(jiān)禁化處理,加大后續(xù)幫教力度,更好地幫助政府收容教養(yǎng)少年回歸社會。最后結(jié)論部分認為,在寄予《違法行為矯治法》較高期待的同時,應(yīng)加大對政府收容教養(yǎng)少年這一特殊群體的關(guān)注,改革和完善政府收容教養(yǎng)制度的執(zhí)行方式,凸顯該制度在降低和減少青少年違法犯罪、促進社會和諧進程中的意義。
[Abstract]:Based on the current mode of implementation of the government's reeducation system and the correctional mode of the government's acceptance of juveniles, this paper compares with the juvenile reeducation through labor and aims at the chaotic situation in the process of implementation of the government's reeducation system. Combined with the author's personal experience in judicial practice, this paper expounds the differences in natural attributes, legal attributes and social attributes between the two kinds of systems, and examines the disadvantages brought about by the indifference between the two systems in the process of implementation. Furthermore, the paper puts forward the basic ideas on the implementation mode of the government's reformatory system and the correctional mode of the young people accepted by the government. The introduction of this paper briefly introduces the current research status of government reeducation system. The first part is devoted to clarifying the concept and nature of government reeducation system and reeducation through labour system, and the concept and nature of government acceptance of juvenile and minor reeducation-through-labor personnel. Applicable object. In the second part, the author reviews the evolution of the government's administration of juvenile and juvenile reeducation through labor, and points out the current judicial situation of the two systems and the integration of the two groups. The third part discusses the differences between juvenile and juvenile reeducation through physiology, sociology, law and corrective practice, and then points out that the two should be treated differently. The fourth and fifth part introduces the current management, education, life and health model of juvenile reeducation through labour, the government's adoption of juvenile education, and the establishment of the authority of the judicial system from the point of view of judicial practitioners. The malpractice of maintaining the physical and mental health of the juvenile delinquent, safeguarding the legitimate rights and interests of the juvenile delinquent and improving the quality of education and correction. In the sixth part, the author puts forward the idea of the concrete implementation mode of the government's reformatory system, through the establishment of juvenile correctional institutions, the transformation of work-study schools, the implementation of home imprisonment, the establishment of community correction projects such as raising families and so on, and the reduction of incarceration. Strengthen the follow-up education efforts, better help the government to take care of young people to return to society. In the last part of the conclusion, while placing high expectations on the Law on the Correction of unlawful acts, we should pay more attention to the special group of young people accepted by the government, and reform and improve the mode of implementation of the government's reformatory system. Highlight the significance of this system in reducing and reducing juvenile delinquency and promoting social harmony.
