【摘要】：多伯特規(guī)則是法院對藥品副作用因果關(guān)系鑒定證據(jù)認(rèn)定中形成的判例規(guī)則,繼而成為了美國法院普遍的科學(xué)證據(jù)標(biāo)準(zhǔn)之一,該規(guī)則在擴(kuò)大應(yīng)用到其他科學(xué)鑒定領(lǐng)域的過程中,須根據(jù)不同科學(xué)方法的特點(diǎn)具體研究規(guī)則的適用問題。形象證據(jù)鑒定是依據(jù)客體形象特征進(jìn)行鑒定的一種科學(xué)方法,其概率性鑒定本質(zhì)可以作為總體上適用多伯特規(guī)則的根據(jù),同時,目前形象鑒定的方法主觀性較強(qiáng)、基礎(chǔ)信息不完備、錯誤概率不明確等特點(diǎn)又決定了還不能完全適應(yīng)規(guī)則標(biāo)準(zhǔn)的要求,在這種情況下,我國應(yīng)該借鑒多伯特規(guī)則辦法,借鑒多伯特規(guī)則的合理成分,結(jié)合形象證據(jù)鑒定的具體情況,制訂原理正確、更具有針對性的認(rèn)定標(biāo)準(zhǔn),通過標(biāo)準(zhǔn)的實(shí)施,推動和提高形象鑒定的科學(xué)性水平。
[Abstract]:The Dorbert rule is the case rule formed by the court in the identification of causation of drug side effects, and has become one of the universal standards of scientific evidence in American courts. This rule has been widely applied to other fields of scientific identification. The application of the rules should be studied according to the characteristics of different scientific methods. The identification of image evidence is a scientific method based on the characteristics of object image. The nature of probabilistic identification can be used as the basis for the application of Dobert's rule in general. At the same time, the method of image identification is subjective at present. The characteristics of incomplete basic information and unclear error probability determine that we can not fully adapt to the requirements of the rules. In this case, we should draw lessons from the method of the Dobert rule and the reasonable components of the Dobert rule. Combined with the specific situation of image evidence identification, the author formulates the correct principle and more targeted identification standard, and promotes and improves the scientific level of image identification through the implementation of the standard.
