司法鑒定機構儀器設備基本配置標準的探討

【摘要】：2005年10月1日《全國人大常委會關于司法鑒定管理的決定》(下稱《決定》)實施以來,司法鑒定機構的準入條件逐步明確、細化,2006年9月1日司法部下發(fā)了《司法鑒定機構儀器設備基本配置標準(暫行)》(下稱《暫行標準》),為司法行政機關開展司法鑒定機構審核登記及檢查、評估提供了具體標準,也為司法鑒定機構的發(fā)展和完善指明了方向。但實行《暫行標準》一年多來,我們可以感到其與司法鑒定體制改革最大限度地利用社會資源的初衷有差距,也與司法鑒定實踐存在著一定差距,為此筆者擬對完善《暫行標準》進行探討。
[Abstract]:Since the implementation of the "decision of the standing Committee of the National people's Congress on the Administration of Judicial expertise" (hereinafter referred to as the "decision") on October 1, 2005, the conditions for admission of judicial appraisal institutions have been gradually clarified and refined. On September 1, 2006, the Ministry of Justice issued the basic Standard for the allocation of Instruments and equipment in Forensic Appraisal institutions (temporary) (hereinafter referred to as the Provisional Standard) to conduct examination, registration and inspection of judicial authentication institutions for the judicial administrative organs. The evaluation provides specific criteria and points out the direction for the development and perfection of forensic institutions. However, in the past more than a year since the implementation of the Provisional Standard, we can feel that there is a gap between it and the original intention of making the maximum use of social resources in the reform of the judicial expertise system, and there is also a certain gap between it and the practice of judicial expertise. Therefore, the author intends to perfect the Provisional Standard.
