【摘要】： 當(dāng)前我國(guó)正處于體制轉(zhuǎn)軌、結(jié)構(gòu)調(diào)整的新時(shí)期,新舊體制轉(zhuǎn)換中的縫隙和漏洞,為腐敗現(xiàn)象的滋生留下了空間。近幾年來,盡管我國(guó)的反貪斗爭(zhēng)取得了很大的成績(jī),黨政機(jī)關(guān)和干部隊(duì)伍中腐敗現(xiàn)象蔓延的勢(shì)頭正逐步得到遏制,一些誘發(fā)貪污犯罪的深層次問題正得到解決。但我們必須看到,貪污現(xiàn)象仍然屢禁不止。在社會(huì)轉(zhuǎn)型的背景下,我國(guó)的貪污犯罪已開始呈現(xiàn)出與之相應(yīng)的特點(diǎn)和變化:貪污罪案件數(shù)逐年上升,犯罪手段呈現(xiàn)多樣化、隱蔽性較強(qiáng)的特點(diǎn),犯罪主體呈現(xiàn)多元化,發(fā)案領(lǐng)域擴(kuò)大化的發(fā)展趨勢(shì),犯罪數(shù)額也越來越大,犯罪官員人數(shù)越來越多,且級(jí)別越來越高。因此,面對(duì)我國(guó)轉(zhuǎn)型期貪污犯罪如此嚴(yán)峻的形勢(shì),深入剖析我國(guó)社會(huì)轉(zhuǎn)型背景下的貪污賄賂犯罪現(xiàn)象的特點(diǎn)及原因,總結(jié)并反思我國(guó)反貪工作的經(jīng)驗(yàn)教訓(xùn),進(jìn)而加強(qiáng)法制、道德教育,建立健全各項(xiàng)規(guī)章制度,完善各項(xiàng)監(jiān)督機(jī)制,從而探索出懲治貪污犯罪問題的對(duì)策與途徑,也就顯得尤為重要。
[Abstract]:At present, our country is in a new period of system transition and structural adjustment. The gaps and loopholes in the transformation of new and old systems leave room for the breeding of corruption. In recent years, despite the great achievements in the anti-corruption struggle in our country, the spreading trend of corruption in party and government organs and cadres is gradually contained, and some deep-seated problems inducing corruption crimes are being solved. But we must see that corruption is still not stopped. Under the background of social transformation, the corruption crimes in our country have begun to show corresponding characteristics and changes: the number of corruption crimes has increased year by year, the criminal means are diversified, the concealment is strong, the main body of crime is diversified. With the expansion of the crime field, the amount of crime is increasing, the number of criminal officials is increasing, and the level of crime is becoming higher and higher. Therefore, in the face of the serious situation of corruption and bribery in the transitional period of our country, the characteristics and causes of corruption and bribery crime in the background of social transformation are deeply analyzed, and the experience and lessons of anti-corruption work in China are summarized and reflected, and then the legal system is strengthened. Moral education, establishing and perfecting the rules and regulations, perfecting the supervision mechanism, and exploring the countermeasures and ways to punish the crime of corruption are especially important.
