【摘要】： 在法律日趨于保護(hù)人權(quán)的今天,慎用死刑是世界大同之趨勢(shì),而刑事司法精神病鑒定無疑是對(duì)死刑攔截的一種行之有效的方式。作為刑事訴訟程序中的重要一環(huán),司法精神病鑒定理應(yīng)在訴訟過程中得到重視,然而我國現(xiàn)行的刑事司法精神病鑒定制度卻存在諸多問題,亟需完善。本文通過對(duì)我國刑事司法精神病鑒定制度現(xiàn)狀的深入考察,針對(duì)我國司法鑒定制度中存在的突出問題,依序討論司法精神病鑒定的啟動(dòng)程序、鑒定人資格和鑒定結(jié)論的質(zhì)證程序,在比較兩大法系司法鑒定制度的基礎(chǔ)上,吸收國外立法的有益經(jīng)驗(yàn),得出重新構(gòu)建我國刑事司法精神病鑒定制度的框架和思路。 本文分引言、三章及結(jié)語共五部分: 引言,簡要介紹2006年轟動(dòng)全國的邱興華案的始末,引出論題。 第一章,共分三節(jié)。分別從我國刑事司法精神病鑒定制度中的啟動(dòng)制度、鑒定人資格制度和鑒定結(jié)論的質(zhì)證制度三方面著手,對(duì)其現(xiàn)狀和弊端進(jìn)行描述評(píng)析。 第二章,共分三節(jié)。依序?qū)纱蠓ㄏ邓痉ㄨb定制度中的啟動(dòng)制度、鑒定人資格制度和鑒定結(jié)論的質(zhì)證制度進(jìn)行分析、比較。 第三章,共分四節(jié)。第一節(jié)探討完善我國刑事司法精神病鑒定制度的理論依據(jù),后三節(jié)依序提出完善我國刑事司法精神病鑒定啟動(dòng)制度、鑒定人資格制度、鑒定結(jié)論的質(zhì)證制度的構(gòu)想。 結(jié)語,對(duì)全文進(jìn)行概括性總結(jié)。
[Abstract]:Nowadays, when the law is increasingly protecting human rights, it is the trend of the world to use the death penalty with caution, and criminal judicial psychiatric examination is undoubtedly an effective way to intercept the death penalty. As an important part of criminal procedure, forensic psychiatric identification should be paid attention to in the process of litigation. However, there are many problems in the current criminal judicial psychiatric identification system in China, which needs to be improved urgently. Based on the in-depth investigation of the present situation of the criminal judicial psychiatric appraisal system in China, this paper discusses the starting procedure of the forensic psychiatric appraisal system in order to solve the outstanding problems in the forensic appraisal system in our country. On the basis of comparing the judicial identification systems of the two legal systems and absorbing the beneficial experience of foreign legislation, the cross-examination procedure of the qualification of experts and the conclusion of identification is put forward, and the framework and train of thought for reconstructing the criminal judicial psychiatric appraisal system of our country are obtained. This paper includes five parts: introduction, three chapters and conclusion: introduction, brief introduction of Qiu Xinghua case in 2006, leading to the topic. The first chapter is divided into three sections. This paper analyzes the current situation and disadvantages of the criminal judicial psychiatric appraisal system from three aspects: the priming system, the qualification system and the cross-examination system. The second chapter is divided into three sections. This paper analyzes and compares the priming system, the qualification system of expert and the cross-examination system of the appraisal conclusion in the two legal systems. Chapter three is divided into four sections. The first section discusses the theoretical basis of perfecting the criminal judicial psychiatric appraisal system in our country. The last three sections put forward the conception of perfecting the criminal judicial psychiatric appraisal starting system, the qualification system of the appraiser and the cross-examination system of the appraisal conclusion according to the order of the last three sections.
