【摘要】： 現(xiàn)代科學(xué)的發(fā)展使得鑒定結(jié)論的科技含量越來越高。鑒定材料作為鑒定結(jié)論的物質(zhì)基礎(chǔ),它的質(zhì)量對案件事實(shí)的查明和證明發(fā)揮著重要的作用。但國內(nèi)理論界對鑒定材料收集少有研究,現(xiàn)行法律對鑒定材料收集標(biāo)準(zhǔn)也未加以規(guī)范,有關(guān)鑒定材料的鑒定條件規(guī)范、鑒定材料的收集程序規(guī)范、鑒定材料收集的技術(shù)方法規(guī)范等均是空白。而在實(shí)踐中,鑒定材料的質(zhì)量不僅對鑒定結(jié)論的證據(jù)價(jià)值產(chǎn)生影響,對于案件的偵破和鑒定結(jié)論的審查與認(rèn)定也有重要意義。本文中,筆者對鑒定材料收集標(biāo)準(zhǔn)規(guī)范化的相關(guān)問題作一探討,以期對鑒定材料收集標(biāo)準(zhǔn)的規(guī)范化研究有所幫助。 本文第一部分從鑒定材料的概念出發(fā),明確界定了鑒定材料的概念、表現(xiàn)形式及其分類,同時(shí)論證了鑒定材料對于鑒定結(jié)論質(zhì)量的影響和對于鑒定結(jié)論證據(jù)價(jià)值的影響,為下文奠定了基礎(chǔ)。 第二部分對鑒定材料收集標(biāo)準(zhǔn)規(guī)范進(jìn)行內(nèi)容之架構(gòu),從鑒定材料收集的數(shù)量、質(zhì)量規(guī)范,鑒定材料的收集主體、行為以及收集后的保全,以及鑒定材料收集技術(shù)方法規(guī)范這三方面逐一進(jìn)行構(gòu)建。 第三部分著重論述我國鑒定材料收集標(biāo)準(zhǔn)的現(xiàn)狀及存在的問題。主要從兩個(gè)方面來進(jìn)行論述,即我國鑒定材料收集標(biāo)準(zhǔn)的現(xiàn)狀,以及我國鑒定材料收集標(biāo)準(zhǔn)存在的問題。 第四部分通過幾種典型鑒定中鑒定材料收集標(biāo)準(zhǔn)的完善來對第二章所談到的內(nèi)容架構(gòu)展開詳細(xì)闡述。具體內(nèi)容包括筆跡鑒定中鑒定材料收集標(biāo)準(zhǔn)的完善;指紋鑒定中鑒定材料收集標(biāo)準(zhǔn)的完善。 全文對鑒定材料收集標(biāo)準(zhǔn)規(guī)范化的相關(guān)問題進(jìn)行了探索性的研究,希望能夠通過研究對這一領(lǐng)域的發(fā)展起到積極的推進(jìn)作用。
[Abstract]:The development of modern science makes the scientific and technological content of the appraisal conclusion more and more high. As the material basis of the appraisal conclusion, the quality of the identification material plays an important role in the identification and proof of the facts of the case. However, there is little research in domestic theoretical circles on the collection of identification materials, and the current laws have not regulated the standards for the collection of identification materials, and the relevant criteria for the identification of identification materials and the procedures for collecting identification materials have not been standardized. The technical methods and specifications for the collection of identification materials are blank. In practice, the quality of identification materials not only has an impact on the value of evidence, but also plays an important role in the detection of cases and the examination and determination of the conclusions. In this paper, the author makes a discussion on the standardization of the standards for the collection of identification materials, in order to be helpful to the standardization of the standards of the collection of identification materials. In the first part of this paper, the concept, manifestation and classification of identification materials are clearly defined from the concept of identification materials. At the same time, the effects of identification materials on the quality of identification conclusions and on the value of evidence of identification conclusions are demonstrated. Laid the foundation for the following. The second part is the framework of the content of the standards and specifications for the collection of identification materials, including the quantity of the collection of the identification materials, the quality norms, the collection subject, the behavior and the preservation after the collection. And the identification material collection technique standard these three aspects carries on the construction one by one. The third part focuses on the status quo and existing problems of the standards for the collection of identification materials in China. This paper mainly discusses from two aspects, that is, the current situation of the standards for the collection of identification materials in China, and the problems existing in the standards of the collection of identification materials in China. The fourth part elaborates the content structure of chapter two by perfecting the standard of collection of identification materials in several typical appraisals. The specific contents include the perfection of the collection standard of identification materials in handwriting identification and the perfection of collection standard of identification materials in fingerprint identification. The full text has carried on the exploratory research to the appraisal material collection standard standardization related question, hoped through the research can play the positive promotion function to this field development.
