【摘要】： 近年來(lái),為適應(yīng)經(jīng)濟(jì)建設(shè)的發(fā)展,我國(guó)法制建設(shè)也隨之在不斷地完善,人們法律意識(shí)也在逐步增強(qiáng),依法治國(guó)、依法行政對(duì)公安機(jī)關(guān)提出了更高的要求。公安工作的核心是執(zhí)法工作。公安機(jī)關(guān)的執(zhí)法水平與執(zhí)法質(zhì)量高低,不僅決定著執(zhí)法機(jī)關(guān)和執(zhí)法者自身的形象和權(quán)威,而且涉及到社會(huì)經(jīng)濟(jì)和文化的各個(gè)方面,尤其關(guān)系到公民的權(quán)利能否得到保障,將會(huì)直接影響到國(guó)家的管理效果,進(jìn)而關(guān)系著社會(huì)的穩(wěn)定和發(fā)展。隨著公安執(zhí)法實(shí)踐向縱深推進(jìn),公安工作和公安隊(duì)伍不適應(yīng)、不符合依法治國(guó)發(fā)展要求的問(wèn)題也凸顯出來(lái)。尤其是在實(shí)施影響公民基本權(quán)利和義務(wù)的具體執(zhí)法行為時(shí),很多情況執(zhí)法者并不嚴(yán)格遵守法定程序,執(zhí)法行為不規(guī)范已成為習(xí)慣。公安機(jī)關(guān)只有主動(dòng)適應(yīng)法治社會(huì)的發(fā)展要求,努力提高執(zhí)法水平和執(zhí)法質(zhì)量,才能為和諧社會(huì)的建設(shè)起到積極的推動(dòng)作用,做出應(yīng)有的貢獻(xiàn)。 本研究從查找基層公安執(zhí)法存在的主要問(wèn)題,分析存在問(wèn)題的原因入手,采用實(shí)證分析法、文獻(xiàn)分析法、專家訪談法對(duì)提高基層公安機(jī)關(guān)執(zhí)法質(zhì)量的長(zhǎng)效機(jī)制的建設(shè)進(jìn)行了初步的探究。本研究共分四個(gè)部分: 第一章為緒論,主要闡述了本研究的背景、目的和意義,國(guó)內(nèi)外相關(guān)研究的進(jìn)展情況,本文的研究思路與研究方法,本文存在的創(chuàng)新點(diǎn)及不足之處; 第二章是以基層公安執(zhí)法實(shí)際為落腳點(diǎn),對(duì)各個(gè)公安執(zhí)法環(huán)節(jié)存在的突出問(wèn)題進(jìn)行了全面歸納與剖析,旨在找到提高基層公安執(zhí)法質(zhì)量的切入點(diǎn)和突破口。 第三章是從執(zhí)法理念、執(zhí)法環(huán)境、內(nèi)部執(zhí)法責(zé)任制及監(jiān)督機(jī)制、外部監(jiān)督機(jī)制等各個(gè)角度對(duì)存在執(zhí)法問(wèn)題的原因進(jìn)行了分析。 第四章是對(duì)提高基層公安執(zhí)法提出了制度建設(shè)方面的設(shè)想。主要有更新執(zhí)法理念,完善執(zhí)法責(zé)任制,優(yōu)化內(nèi)部執(zhí)法監(jiān)督,拓展整合外部監(jiān)督力量等方面的構(gòu)想,具有較強(qiáng)的可操作性。
[Abstract]:In recent years, in order to adapt to the development of economic construction, the legal system construction of our country has been constantly perfected, and people's legal consciousness has been gradually strengthened, and the rule of law and administration by law have put forward higher requirements to the public security organs. The core of public security work is law enforcement. The level and quality of law enforcement by public security organs not only determines the image and authority of law enforcement agencies and law enforcers themselves, but also involves all aspects of social economy and culture, especially whether the rights of citizens can be guaranteed. Will directly affect the management of the country, and then related to social stability and development. With the practice of public security law enforcement advancing in depth, the problem that the public security work and the public security team do not adapt to the development of governing the country according to the law is also highlighted. Especially in the implementation of specific law enforcement actions that affect the basic rights and obligations of citizens, many law enforcers do not strictly abide by the legal procedures, and law enforcement has become a habit. Only when the public security organs actively adapt to the requirements of the development of a society ruled by law and strive to improve the level and quality of law enforcement, can they play a positive role in promoting the construction of a harmonious society and make due contributions. In this study, the main problems in the law enforcement of public security at the grass-roots level are found, and the causes of the problems are analyzed, and the empirical analysis method and the literature analysis method are used. The expert interview method has carried on the preliminary exploration to the improvement grass-roots public security organ law enforcement quality long-effect mechanism construction. This research is divided into four parts: the first chapter is the introduction, mainly describes the background, purpose and significance of this study, the progress of related research at home and abroad, the research ideas and research methods. The second chapter summarizes and analyzes the outstanding problems existing in various public security law enforcement links, taking the reality of law enforcement at the grass-roots level as the foothold. The aim is to find the breakthrough point and breakthrough of improving the law enforcement quality of public security at the grass-roots level. The third chapter analyzes the reasons of law enforcement problems from the perspectives of law enforcement concept, law enforcement environment, internal law enforcement responsibility system and supervision mechanism, external supervision mechanism and so on. The fourth chapter is to improve the grass-roots public security law enforcement put forward the system construction. It is feasible to renew the concept of law enforcement, perfect the responsibility system of law enforcement, optimize the internal supervision of law enforcement, and expand the integration of external supervision forces.
