【摘要】： 勞動(dòng)教養(yǎng)這一中國(guó)所特有的法律制度,在半個(gè)多世紀(jì)的實(shí)踐中發(fā)揮了重要作用。但是隨著我國(guó)“依法治國(guó)”方略的確立和對(duì)人權(quán)保障的日益重視,勞動(dòng)教養(yǎng)自身的缺陷和歷史局限性日益凸顯,勞動(dòng)教養(yǎng)制度面臨著質(zhì)疑和挑戰(zhàn),迫切需要改革。本文首先對(duì)我國(guó)的勞動(dòng)教養(yǎng)制度的概念與性質(zhì),歷史與現(xiàn)狀,問(wèn)題與缺陷進(jìn)行解讀;其次,從歷史、現(xiàn)實(shí)和法制功能的角度分析了勞動(dòng)教養(yǎng)制度的合理性;再次,通過(guò)對(duì)勞動(dòng)教養(yǎng)制度與國(guó)外尤其是日本輕罪制度的對(duì)比研究,從中獲取勞動(dòng)教養(yǎng)制度改革的啟示;最后,對(duì)勞動(dòng)教養(yǎng)制度改革模式設(shè)想進(jìn)行了分析和評(píng)價(jià),特別對(duì)勞動(dòng)教養(yǎng)制度司法化改革的設(shè)想提出了筆者的建議。
[Abstract]:Reeducation through labor, a unique legal system in China, has played an important role in the practice of more than half a century. However, with the establishment of the general plan of "ruling the country by law" and the increasing attention to the protection of human rights, the defects and historical limitations of reeducation through labor are becoming increasingly prominent, and the system of re-education through labor is facing challenges and challenges, which urgently need to be reformed. Firstly, this paper analyzes the concept and nature, history and present situation, problems and defects of the system of re-education through labor in China. Secondly, it analyzes the rationality of the system from the perspective of history, reality and the function of legal system. Through a comparative study of the reeducation through labor system and the misdemeanor system abroad, especially in Japan, the enlightenment of the reform of the reeducation through labor system is obtained. Finally, the assumption of the reform mode of the reeducation through labor system is analyzed and evaluated. In particular, the author's suggestions are put forward for the reform of the judicial reform of the reeducation through labor system.
