【摘要】： 本文共分四章：第一章是對測謊技術(shù)的簡要介紹,分兩節(jié)介紹了測謊技術(shù)在中西方的發(fā)展歷程,原理方法、可靠性及影響因素。第二章考察了測謊技術(shù)在國內(nèi)外的應(yīng)用及爭議。主要考察了該技術(shù)在美、日、德、意、俄和中國的應(yīng)用現(xiàn)狀,通過論述,對測謊是否違反無罪推定原則、與刑訊逼供的關(guān)系等問題發(fā)表了看法。第三章著重分析了測謊結(jié)論的證據(jù)屬性及所屬種類。首先分析并證明測謊結(jié)論具有證據(jù)屬性,并探討了測謊結(jié)論的證據(jù)種類歸屬。第四章重點研究了測謊結(jié)論在我國刑事訴訟中的適用原則及測謊技術(shù)應(yīng)用規(guī)范,探討了測謊結(jié)論成為證據(jù)應(yīng)遵循的若干原則,提出了規(guī)范測謊儀、測謊機構(gòu)、技術(shù)人員和適用范圍的建議。
[Abstract]:This article is divided into four chapters: The first chapter is a brief introduction to polygraph technology, divided into two sections to introduce the development of polygraph technology in China and the West, principles, methods, reliability and influencing factors. The second chapter examines the application of polygraph technology at home and abroad and controversy. Chapter 3 focuses on the analysis of the evidence attributes and types of polygraph conclusions. First, it analyzes and proves that polygraph conclusions have evidence attributes, and discusses the types of evidence attributes of polygraph conclusions. Chapter 4 focuses on the polygraph conclusions. The applicable principles and the application standards of lie detection technology in China's criminal procedure are discussed. Some principles that should be followed when the conclusion of lie detection becomes evidence are discussed.
