【摘要】：本課題研究民事訴訟制度背景下的鑒定結(jié)論相關(guān)問題，對鑒定結(jié)論的采信必然要遵循民事訴訟的基本規(guī)律和民事證據(jù)制度的基本理論。本課題的研究目標主要有鑒定結(jié)論的概念和基本原理,鑒定結(jié)論的功能,鑒定結(jié)論的構(gòu)成要件及證據(jù)能力,鑒定結(jié)論作為司法證據(jù)的歷史沿革,司法鑒定的性質(zhì),司法鑒定體制的現(xiàn)狀及對鑒定結(jié)論運用的影響,鑒定結(jié)論在民事審判實踐中運用的概況等基本問題,以鑒定結(jié)論的證據(jù)屬性和證據(jù)效力為切入點,把握民事訴訟中涉及司法鑒定結(jié)論啟動生成和審查認定的主要矛盾和問題,探尋司法審判公正與效率的路徑。在此基礎(chǔ)上對司法鑒定結(jié)論的生成,鑒定體制和機制的構(gòu)建和完善,包括進一步完善司法鑒定管理體制、為鑒定結(jié)論的有效生成提供體制性保障,進一步規(guī)范司法鑒定的啟動程序、使鑒定結(jié)論的運用必要且合理,完善統(tǒng)一對外委托的流程管理機制、保障鑒定委托工作公正高效,完善鑒定實施中的監(jiān)督機制、保障鑒定結(jié)論生成的權(quán)威性；鑒定結(jié)論審查認證程序的規(guī)則構(gòu)建,包括鑒定結(jié)論的質(zhì)證標準和規(guī)則,專家輔助人制度的構(gòu)建,鑒定結(jié)論的認證模式,鑒定結(jié)論的認證規(guī)則,鑒定結(jié)論認證的證明力采信規(guī)則等提出完善模式。
[Abstract]:This paper studies the related problems of the appraisal conclusion under the background of the civil litigation system. The adoption of the appraisal conclusion must follow the basic law of the civil action and the basic theory of the civil evidence system. The research goal of this subject mainly includes the concept and basic principle of the appraisal conclusion, the function of the appraisal conclusion, the composing elements and the evidence ability of the appraisal conclusion, the historical evolution of the appraisal conclusion as the judicial evidence, the nature of the judicial appraisal. The present situation of the judicial expertise system and its influence on the application of the appraisal conclusion, the general situation of the application of the appraisal conclusion in the civil trial practice, and so on, take the evidence attribute and the evidence effect of the appraisal conclusion as the breakthrough point. To grasp the main contradictions and problems involved in the initiation and examination of the conclusion of judicial expertise in civil litigation, and to explore the path of judicial justice and efficiency. On this basis, the formation of the conclusion, the construction and improvement of the appraisal system and mechanism, including the further improvement of the management system of the judicial expertise, provide the institutional guarantee for the effective generation of the conclusion. To further standardize the starting procedure of judicial expertise, to make the application of appraisal conclusions necessary and reasonable, to perfect the unified process management mechanism of entrusting to foreign countries, to ensure the fairness and efficiency of the work of accreditation entrustment, and to perfect the supervision mechanism in the implementation of appraisal, To ensure the authoritativeness of the formation of the appraisal conclusion, to establish the rules for examining the authentication procedure, including the standard and rules for cross-examination of the appraisal conclusion, the construction of the expert assistant system, the authentication model for the appraisal conclusion, the authentication rule for the appraisal conclusion, Certification of the identification of the proof of the rules of acceptance of the proposed perfect model.
