練習(xí)摹仿筆跡鑒定研究

【摘要】： 本文對練習(xí)摹仿筆跡鑒定進(jìn)行了全面、系統(tǒng)的研究和論述。 現(xiàn)階段,在所受理的各類筆跡案件中,行為人在借據(jù)、收據(jù)、批示、合同、協(xié)議等筆跡中采用練習(xí)摹仿手法進(jìn)行犯罪的案件呈上升趨勢。摹仿人如果占有摹樣,對筆跡加以分析研究,并經(jīng)過反復(fù)練習(xí)后書寫的字跡酷似被摹仿人筆跡,仿真度高、隱蔽性強,鑒定難度大。本文正是通過對練習(xí)摹仿筆跡的理論基礎(chǔ)和鑒定要點的論述,解決練習(xí)摹仿筆跡鑒定方面的問題。 練習(xí)摹仿筆跡與其他摹仿筆跡有諸多相同之處,但又有自身的特點。兩者在形成原理、形成方式上相似,而在書寫手法和書寫條件等方面又有不同之處。練習(xí)摹仿筆跡鑒定是通過對檢材筆跡和樣本筆跡進(jìn)行分別檢驗、比較檢驗和綜合評斷后,做出是否為同一人書寫的結(jié)論的一種司法鑒定活動。如何準(zhǔn)確識別練習(xí)摹仿筆跡,分析、確定筆跡特征,以及做出同一認(rèn)定結(jié)論,是練習(xí)摹仿筆跡鑒定的關(guān)鍵。同時,在涉及練習(xí)摹仿筆跡的案件偵查中,還要綜合分析案件情況、書寫條件、書寫時間、書寫水平和嫌疑人時空條件等,從而為偵查和鑒定提供依據(jù)。 對練習(xí)摹仿筆跡的研究是筆跡檢驗的難點和熱點,對實踐具有指導(dǎo)作用。本文在汲取相關(guān)知識成果的基礎(chǔ)上,對練習(xí)摹仿的概念、形成原理、特點、分類、特征價值、鑒別方法以及同一認(rèn)定規(guī)范進(jìn)行了全面系統(tǒng)的論述,希望能在更大程度上豐富和完善摹仿筆跡鑒定的理論,為鑒定實踐提供理論支持。 本文共計四章,三萬六千余字。 第一章為緒論,主要包括摹仿筆跡的歷史、練習(xí)摹仿筆跡的概念、練習(xí)摹仿筆跡的研究現(xiàn)狀以及研究練習(xí)摹仿筆跡鑒定的意義。本章通過對摹仿筆跡歷史的回顧,提出了練習(xí)摹仿筆跡的完整概念,同時簡要分析了練習(xí)摹仿筆跡的研究現(xiàn)狀與價值,為下一章節(jié)內(nèi)容的闡述做鋪墊。 第二章是對練習(xí)摹仿筆跡基礎(chǔ)理論的研究,包括練習(xí)摹仿的形成機(jī)制和鑒定依據(jù)、練習(xí)摹仿與其他摹仿手法的區(qū)別、練習(xí)摹仿筆跡的分類和特點。此章節(jié)是本文的基礎(chǔ)。 第三章則是對練習(xí)摹仿筆跡特征的實證研究,具體內(nèi)容包括練習(xí)摹仿筆跡特征的價值分析和影響練習(xí)摹仿筆跡特征的相關(guān)因素兩方面。在該類筆跡鑒定中,能否得出科學(xué)可靠的鑒定結(jié)論,分析筆跡特征的價值和影響因素至關(guān)重要,這也是鑒定可行性和有效性的基本前提。本章節(jié)采用實證研究方法,廣泛收集筆跡樣本,通過科學(xué)分類分析了練習(xí)摹仿筆跡鑒定的理論基礎(chǔ)。 第四章為練習(xí)摹仿筆跡鑒定的方法要點和同一認(rèn)定規(guī)范。這一章是全文的重點和難點。鑒定方法不科學(xué),方法選擇不準(zhǔn)確,操作失誤,結(jié)論的科學(xué)性就很難保障�！盁o規(guī)矩不成方圓”,沒有科學(xué)統(tǒng)一的鑒定規(guī)范,鑒定結(jié)論的正確性和規(guī)范性就無從談起。本章探討了練習(xí)摹仿筆跡的識別和檢驗方法,鑒定過程中的注意事項,以及同一認(rèn)定的條件和規(guī)范,以期能進(jìn)一步豐富練習(xí)摹仿筆跡鑒定理論,為鑒定實踐提供理論支持。
[Abstract]:This paper makes a comprehensive and systematic study and Discussion on the practice of imitation handwriting identification.
At the present stage, in all kinds of handwriting cases accepted, there is an increasing tendency for the perpetrator to practice imitation in the handwriting such as vouchers, receipts, instructions, contracts and agreements. This paper is to discuss the theoretical basis and identification points of practicing imitation handwriting, and to solve the problem of practicing imitation handwriting identification.
Practice imitation handwriting has many similarities with other imitation handwriting, but it has its own characteristics. They are similar in forming principle and forming way, but different in writing technique and writing condition. Practice imitation handwriting identification is by examining handwriting and sample handwriting separately, comparing and evaluating comprehensively. How to accurately identify the practice of imitating handwriting, analyze, determine the characteristics of handwriting, and draw the same conclusion is the key to practice imitating handwriting identification. At the same time, in the investigation of cases involving the practice of imitating handwriting, it is necessary to comprehensively analyze the case and write notes. Writing time, writing level and suspect's space-time conditions provide the basis for investigation and identification.
The study of practice imitation handwriting is a difficult and hot spot in handwriting examination, and it is instructive to practice. Based on the achievements of relevant knowledge, this paper makes a comprehensive and systematic exposition on the concept of practice imitation, forming principle, characteristics, classification, characteristic value, distinguishing method and identical criterion, hoping to be more comprehensive and systematic. Enrich and perfect the theory of imitation handwriting appraisal, and provide theoretical support for appraisal practice.
This article has four chapters and 36000 words.
The first chapter is the introduction, which mainly includes the history of imitation handwriting, the concept of practicing imitation handwriting, the research status quo of practicing imitation handwriting and the significance of practicing imitation handwriting identification. Form and value, laying the groundwork for the contents of the next chapter.
The second chapter is the study of the basic theory of practice imitation handwriting, including the formation mechanism and identification basis of practice imitation, the difference between practice imitation and other imitation techniques, the classification and characteristics of practice imitation handwriting.
The third chapter is an empirical study on the characteristics of practice imitation handwriting, which includes the value analysis of practice imitation handwriting and the related factors affecting the characteristics of practice imitation handwriting. This chapter uses empirical research methods to collect a wide range of handwriting samples, and analyzes the theoretical basis of practicing copying handwriting identification through scientific classification.
Chapter Four is the key points and the same criterion of practicing the identification of imitative handwriting.This chapter is the focus and difficulty of the whole paper.The scientific conclusion is difficult to guarantee if the identification method is unscientific,the selection of methods is inaccurate and the operation is wrong. This chapter discusses the methods of identifying and checking imitative handwriting, the matters needing attention in the process of identification, and the conditions and norms for identifying the same handwriting so as to enrich the theory of identifying imitative handwriting and provide theoretical support for the practice of identification.
