【摘要】：當(dāng)前,改革的深化導(dǎo)致社會格局的巨大變動及利益沖突的不斷加劇,隨之而來的是轉(zhuǎn)型時期國內(nèi)群體性事件的高發(fā)態(tài)勢,其表現(xiàn)形式多樣,影響廣泛,對社會秩序和經(jīng)濟(jì)的發(fā)展造成了極大的破壞,已成為社會和諧發(fā)展進(jìn)程中不得不面對和解決的難題。群體性事件多數(shù)是基層政府和公民的矛盾,或原本不是的但最后都演變?yōu)閮烧咧g的沖突�；鶎诱鳛閲覚C(jī)器與人民群眾的紐帶,既是國家法律法規(guī)、大政方針的執(zhí)行者,又是主導(dǎo)地方各個領(lǐng)域的管理者,具有維護(hù)社會穩(wěn)定、防范群體性事件的職責(zé)�；鶎诱畬θ后w性事件處置能力是其執(zhí)政能力的一個重要方面,如何在事前積極預(yù)防、事中有效應(yīng)對和事后妥善處理群體性事件,確保社會和經(jīng)濟(jì)的穩(wěn)定發(fā)展是擺在基層政府面前的一個關(guān)鍵問題,可以說,群體性事件的產(chǎn)生與發(fā)展、防范與處置都充滿著基層政府職能問題的思考。本文圍繞基層政府處置群體性事件存在的問題及對策這一主線,采用文獻(xiàn)研究、比較研究、案例分析和結(jié)合實際等方法,分析了當(dāng)前基層政府在處置群體性事件中存在的問題及原因,通過對比借鑒國外的處置方法,針對存在問題的原因著重提出各種改進(jìn)的處置策略,以期提高基層政府對群體性事件的處置能力。本文主要分為五個部分：第一部分是緒論,主要介紹了本文的研究背景、目的及意義,在綜述國內(nèi)外研究現(xiàn)狀的基礎(chǔ)之上,提出本文的研究思路和方法。第二部分是相關(guān)概念和理論,包括對群體性事件和基層政府的相關(guān)概念進(jìn)行界定和說明,及與群體性事件相關(guān)的法治理論、“第三部門”管理理論以及危機(jī)管理理論進(jìn)行概要概述。第三部分是我國基層政府處置群體性事件存在的問題及原因分析,通過闡述當(dāng)前基層政府的處置現(xiàn)狀,以典型案例為支撐,對基層政府處置群體性事件存在的主要問題及原因進(jìn)行分析。第四部分是關(guān)于西方發(fā)達(dá)國家處置群體性事件的經(jīng)驗借鑒,通過對英、法、德和美四國的處置方法進(jìn)行分析,總結(jié)值得我國借鑒的經(jīng)驗和方法。第五部分是結(jié)合我國基層政府工作實際,對基層政府處置群體性事件的思路、原則、策略及善后工作進(jìn)行論述。
[Abstract]:At present, the deepening of reform has led to great changes in the social structure and the continuous intensification of conflicts of interest, followed by a high incidence of mass events in the period of transition, which is manifested in a variety of forms and has a wide range of influences. It has caused great damage to the social order and economic development, and has become a difficult problem that has to be faced and solved in the process of social harmonious development. Group incidents are mostly conflicts between grass-roots government and citizens, or conflicts between them. As a link between the state machinery and the masses, the grass-roots government is not only the executor of national laws and regulations, but also the manager of leading local areas. It has the duty of maintaining social stability and preventing mass incidents. The ability of grass-roots government to deal with group incidents is an important aspect of its ruling ability. To ensure the stable development of society and economy is a key problem in front of the grass-roots government. It can be said that the emergence and development of mass incidents, prevention and treatment are full of thinking about the functions of grass-roots governments. This paper focuses on the problems and countermeasures of grass-roots government in dealing with group incidents, and adopts the methods of literature research, comparative study, case analysis and combination of practice, etc. This paper analyzes the existing problems and reasons of the grass-roots government in dealing with group incidents, by comparing and drawing lessons from the foreign disposal methods, and puts forward various improved disposal strategies for the reasons of the problems. In order to improve the grass-roots government to deal with group incidents. This paper is divided into five parts: the first part is the introduction, mainly introduces the research background, purpose and significance of this paper, on the basis of summarizing the current research situation at home and abroad, puts forward the research ideas and methods of this paper. The second part is the related concepts and theories, including the definition and explanation of group events and the related concepts of grass-roots government, and the theory of rule of law related to group incidents. The third sector management theory and crisis management theory are summarized. The third part is the analysis of the problems and causes of the grass-roots government dealing with the mass incidents, through the exposition of the current situation of the grass-roots government, supported by typical cases, This paper analyzes the main problems and causes of grass-roots government dealing with mass incidents. The fourth part is about the western developed countries' experience in dealing with group incidents, through the analysis of the British, French, German and American four countries' handling methods, summed up the experience and methods worthy of our country's reference. The fifth part discusses the ideas, principles, strategies and after-care work of the grass-roots government dealing with mass incidents in combination with the reality of our country's grass-roots government work.
