【摘要】：治安理論與實(shí)踐的上位概念或核心范疇———能夠規(guī)定、衍生治安學(xué)基本概念的范疇———是國(guó)家關(guān)于治安價(jià)值、政策、制度、策略、工具選擇的理論邏輯起點(diǎn)。治安學(xué)理論研究狀況凸顯了我國(guó)治安學(xué)界在"理論治安學(xué)"構(gòu)建方面存在的最需要關(guān)注的缺陷———治安學(xué)思想始終缺乏一個(gè)強(qiáng)有力的上位的核心概念。安全是主體對(duì)客觀的安全狀態(tài)的反映。治安學(xué)論域的安全不是一種實(shí)體,而是一種社會(huì)關(guān)系,一種人與人、人與社會(huì)、人與自然以及社會(huì)與自然的非危險(xiǎn)關(guān)系———社會(huì)安全關(guān)系,其典型結(jié)構(gòu)形態(tài)是"社區(qū)安全復(fù)合體"。治安秩序是由國(guó)家安全政策、治安行政和刑事法律、法規(guī)所確定和協(xié)調(diào)的以社會(huì)、社區(qū)安全關(guān)系為核心的社會(huì)關(guān)系的外顯形態(tài)。安全是秩序的實(shí)質(zhì)內(nèi)容,秩序是安全的規(guī)則形式,安全與秩序具有共在性。安全關(guān)系是治安領(lǐng)域固有的唯一的自變量,是劃分治安秩序邊界的根本依據(jù)。社會(huì)共同體及其主體間的安全關(guān)系行動(dòng)有"圈地自守型"、"攻城略地型"、"分工協(xié)作型"和"和諧發(fā)展型"四種基本類型,分別決定著各個(gè)層次不同的治安秩序運(yùn)行形式。
[Abstract]:The upper concept or the core category of the theory and practice of public security-which can stipulate and derive the basic concept of public security-is the logical starting point of the state's theory of public security value, policy, system, strategy and tool choice. The research situation of the theory of public security has highlighted the defects in the construction of "theory of public order" in the field of public security in our country, that is, the lack of a strong upper core concept in the theory of public security. Safety is the reflection of the subject to the objective security state. Security in the realm of public security is not an entity, but a social relationship, a non-dangerous relationship between man and man, between man and society, between man and nature, and between society and nature. Its typical structural form is "community safety complex". Public order is an explicit form of social relations which is defined and coordinated by national security policies, public security administration and criminal laws and regulations, with social and community security relations as the core. Security is the essential content of order and order is the rule form of security. Security relationship is the only independent variable inherent in the field of public security and the fundamental basis for dividing the boundary of public order. There are four basic types of security relations between the social community and its subjects: "self-defense", "attacking the cities slightly", "division of labor and cooperation" and "harmonious development", which respectively determine the different operation forms of public order at different levels.
