【摘要】： 近年來,職務(wù)犯罪泛濫成災(zāi),普遍地存在于各種權(quán)力領(lǐng)域中,成為現(xiàn)代國家肌體中的“惡性腫瘤”,嚴重損害了政府的公信力、侵害了經(jīng)濟基礎(chǔ),敗壞了社會風氣。如何更有效地預(yù)防職務(wù)犯罪是我們進行職務(wù)犯罪研究的目標。本文以“現(xiàn)象——成因——預(yù)防”這樣一種基本的犯罪學研究范式為線索,對職務(wù)犯罪展開了深入的探討。通過揭示職務(wù)犯罪這一現(xiàn)象的基本問題,包括職務(wù)犯罪的概念、特點和職務(wù)犯罪的現(xiàn)狀、危害,提出職務(wù)犯罪的成因包括外部原因和內(nèi)部原因。進而以職務(wù)犯罪的成因為職務(wù)犯罪研究中承前啟后的因素,總結(jié)出職務(wù)犯罪的預(yù)防借鑒、預(yù)防措施和預(yù)防意義。并希冀本文可以對職務(wù)犯罪的預(yù)防工作提供一點理論支持。
[Abstract]:In recent years, job-related crimes are widespread in various fields of power and become "malignant tumors" in the body of modern countries, which have seriously damaged the credibility of the government, infringed on the economic base, and damaged the social atmosphere. How to prevent duty crime more effectively is the goal of our research. Based on the basic criminological research paradigm of "phenomenon-causation-prevention", this paper makes an in-depth study of job-related crime. By revealing the basic problems of the phenomenon of duty crime, including the concept, characteristics, present situation and harm of duty crime, the paper puts forward the causes of duty crime, including external and internal causes. Then, the author sums up the prevention reference, preventive measures and preventive significance of duty crime by taking the factors of connecting the past and the future in the research of duty crime. It is hoped that this paper can provide some theoretical support for the prevention of job-related crimes.
