【摘要】：改革開放以來,我國(guó)社會(huì)環(huán)境發(fā)生了巨大的變化。警察的職能由過去相對(duì)較強(qiáng)的專政職能轉(zhuǎn)變?yōu)榇驌舴缸锱c服務(wù)人民并重,警察的任務(wù)不斷增加,槍支使用上卻一步步被壓縮,部分基層警察到了 “無槍可用”的境地。然而,近年來隨著國(guó)家和社會(huì)層面矛盾的增多,警察對(duì)槍支使用的需求不斷增加,如何在保證合理合法的基礎(chǔ)上,滿足警察用槍需求是當(dāng)前亟需研究和解決的問題。本文的主要脈絡(luò)是提出問題、分析問題、解決問題。文章開頭介紹本文的研究背景、研究意義、研究方法以及研究理論。接著對(duì)我國(guó)槍支使用的相關(guān)資料進(jìn)行了梳理,主要從槍支管理、用槍立法、用槍問題以及其他國(guó)家和地區(qū)用槍研究等四方面進(jìn)行了概括。在此基礎(chǔ)上,對(duì)我國(guó)當(dāng)前警察槍支使用現(xiàn)狀進(jìn)行了描述,進(jìn)而指出當(dāng)前我國(guó)槍支使用中存在的問題主要是“不愿用槍”、“不敢用槍”、“不會(huì)用槍”。針對(duì)當(dāng)前我國(guó)警察槍支使用中存在的問題,本文進(jìn)行了分析,主要從法律規(guī)定、槍支管理、槍支訓(xùn)練、使用責(zé)任等四方面深入剖析我國(guó)警察不愿、不敢、不會(huì)用槍的深層次原因,為提出解決辦法指明方向。與此同時(shí),對(duì)其他國(guó)家和地區(qū)警察的先進(jìn)的槍支使用經(jīng)驗(yàn)進(jìn)行介紹,為我國(guó)槍支使用提供借鑒。文中主要介紹了美國(guó)、英國(guó)以及我國(guó)香港地區(qū)的警察槍支使用狀況,三地情況不同、條件不同,都結(jié)合自身實(shí)際情況發(fā)展出了適合自己的警察槍支使用制度,這對(duì)我國(guó)警察槍支使用不無啟發(fā)。最后,針對(duì)我國(guó)警察槍支使用中存在的問題,在借鑒三地先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上,提出了我國(guó)警察槍支使用的解決辦法,從完善法律法規(guī)、改進(jìn)槍支管理、按照警種和任務(wù)使用槍支、改進(jìn)槍支訓(xùn)練、加大宣傳力度等五個(gè)方面提出了自己的建議,所提建議出于實(shí)踐,具有較強(qiáng)的可操作性,對(duì)于改善我國(guó)警察槍支使用具有現(xiàn)實(shí)意義。最后對(duì)全文進(jìn)行總結(jié)評(píng)述,提出對(duì)我國(guó)警察槍支使用的展望。
[Abstract]:Since the reform and opening up, China's social environment has undergone tremendous changes. The function of the police has changed from a relatively strong dictatorship in the past to that of cracking down on crime and serving the people. The tasks of the police have been increasing, but the use of guns has been compressed step by step, and some grass-roots policemen have come to the situation of "no guns available". However, with the increase of contradiction between the state and the society in recent years, the demand of the police for the use of guns is increasing. How to meet the demand of the police for guns on the basis of reasonable and legal means is a problem that needs to be studied and solved urgently. The main thread of this paper is to propose problems, analyze problems, and solve problems. At the beginning of the article, the research background, significance, research methods and research theory are introduced. Then the related materials of gun use in our country are combed, which are summarized from four aspects: gun management, gun legislation, gun problem and other countries and regions. On this basis, this paper describes the present situation of police gun use in China, and points out that the main problems in the use of guns in our country are "not willing to use guns", "dare not to use guns" and "can't use guns". In view of the problems existing in the use of police guns in our country, this paper analyzes mainly from four aspects: legal regulation, gun management, gun training, use responsibility, and so on. Does not use the gun deep level reason, pointed out the direction for the proposed solution. At the same time, the advanced experience of police in other countries and regions is introduced to provide reference for the use of guns in our country. This paper mainly introduces the use of police guns in the United States, the United Kingdom and Hong Kong. The three places have different situations and different conditions, and have developed a police gun use system suitable for themselves in the light of their own actual situation. This has inspired the use of guns by the police in our country. Finally, aiming at the problems existing in the use of police guns in our country, on the basis of the advanced experience of the three places, this paper puts forward the solutions to the use of police guns in our country, in order to perfect the laws and regulations and improve the gun management. The author puts forward his own suggestions in five aspects, such as using guns according to police types and tasks, improving gun training and increasing propaganda. The suggestions are practical and operable, and have practical significance for improving the use of police guns in our country. Finally, the paper summarizes and comments on the use of police guns in China.
