【摘要】：開井放油、打孔盜油、盜竊和破壞石油生產(chǎn)設(shè)施的現(xiàn)象,在全國各個油田都有發(fā)生,"三小一點"為涉油犯罪提供了銷贓路徑,涉油犯罪愈演愈烈。相比之下,不斷出臺的政策和法律似乎顯得蒼白無力,如何有效規(guī)制涉油犯罪,從而保護(hù)社會、經(jīng)濟(jì)、環(huán)境的安全與穩(wěn)定,成為時下需要深入思考的問題。本文總結(jié)了涉油犯罪的特征,剖析了犯罪的成因,并用法學(xué)、管理學(xué)、經(jīng)濟(jì)學(xué)、系統(tǒng)科學(xué)等交叉學(xué)科理論,從涉油犯罪成本、犯罪控制系統(tǒng)、產(chǎn)業(yè)鏈、利益分配等角度進(jìn)行了規(guī)制路徑的新選擇。
[Abstract]:The phenomena of oil opening, drilling and stealing oil, stealing and destroying oil production facilities have occurred in every oil field in China. The "three small points" provide a way to protect the oil crimes, and the oil crimes become more and more serious. In contrast, the policies and laws appear to be weak, how to effectively regulate oil-related crimes, thereby protecting the social, economic, environmental security and stability, has become a need for in-depth thinking. This paper summarizes the characteristics of oil-related crime, analyzes the causes of the crime, and uses the interdisciplinary theories of law, management, economics and systems science to analyze the cost of oil-related crime, crime control system, industrial chain, etc. The new choice of regulation path is carried out from the angle of benefit distribution.
