【摘要】：同意論是一種較為包容的思想,主張個(gè)體基于意向上的知情和行動(dòng)上的自由,自愿做出符合自身自由意志的選擇行為。從思想史來(lái)看,同意論較多體現(xiàn)在古典社會(huì)契約論中,例如霍布斯、洛克、盧梭等人都提出了同意觀點(diǎn),以此解釋政治權(quán)威和政治義務(wù)的關(guān)系問(wèn)題。此外,黑格爾的承認(rèn)思想和哈貝馬斯的交往理論也包含了同意因素,他們都強(qiáng)調(diào)自我意識(shí)和主體地位的重要性。另外,社會(huì)主義核心價(jià)值觀所強(qiáng)調(diào)的人民主體地位、平等、公平等,也蘊(yùn)含著同意論思想。從具體內(nèi)容來(lái)看,同意包括程序同意和實(shí)質(zhì)同意。同意論有利于解釋政治權(quán)威和政治義務(wù)的關(guān)系,有利于實(shí)現(xiàn)人的多元利益訴求,有利于形成公民的集體認(rèn)同感。尤為重要的是,同意論思想能夠?yàn)槲覈?guó)社會(huì)矛盾化解提供新的思路。在社會(huì)轉(zhuǎn)型期,隨著經(jīng)濟(jì)快速發(fā)展,人們的權(quán)利意識(shí)和參與意識(shí)不斷增強(qiáng),社會(huì)群體的利益訴求日趨多元化,社會(huì)矛盾也不斷涌現(xiàn)。而問(wèn)題在于,現(xiàn)有的社會(huì)矛盾化解機(jī)制在發(fā)揮重要作用的同時(shí),也暴露出諸多弊病。同意論作為一種重要理論資源,在如何建構(gòu)合理的社會(huì)矛盾化解機(jī)制上具有積極意義。立足于同意論基礎(chǔ)上的社會(huì)矛盾化解機(jī)制,將在推進(jìn)制度建設(shè),提高公眾主體地位,提升民主參與程度,調(diào)節(jié)多元利益訴求等方面發(fā)揮積極作用,從而在根源層面上緩解民眾的社會(huì)不滿情緒,為化解社會(huì)矛盾提供根基性規(guī)范機(jī)制。
[Abstract]:The theory of consent is a kind of more inclusive thought, which advocates that the individual, based on the intention of knowledge and the freedom of action, voluntarily makes the choice according with his own free will. From the history of thought, the theory of consent is more embodied in the classical theory of social contract, such as Hobbes, Locke, Rousseau and other people put forward the view of consent, so as to explain the relationship between political authority and political obligations. In addition, Hegel's theory of recognition and Habermas's theory of communication also contain the factor of consent, which emphasizes the importance of self-consciousness and subject status. In addition, the socialist core values emphasize the people's main position, equality, fairness and so on, also contains the theory of consent. From the specific content, consent includes procedural consent and substantive consent. The theory of consent is helpful to explain the relationship between political authority and political obligation, to realize people's pluralistic interests and to form the collective identity of citizens. It is especially important that the theory of consent can provide new ideas for the solution of social contradictions in our country. In the period of social transformation, with the rapid development of economy, people's consciousness of right and participation is increasing, the interests of social groups are becoming more and more diverse, and social contradictions are emerging. The problem is that the existing social conflict resolution mechanism plays an important role, but also exposes many shortcomings. As an important theoretical resource, the theory of consent has a positive significance in how to construct a reasonable mechanism of resolving social contradictions. The mechanism of resolving social contradictions based on the theory of consent will play an active role in promoting the construction of the system, improving the status of the public as the main body, enhancing the degree of democratic participation, and regulating the demands of multiple interests. In order to alleviate the people's social discontent at the root level, to resolve social contradictions to provide a fundamental normative mechanism.
