【摘要】：近年來,無論從成克杰貪污腐敗案到陳良宇腐敗案,還是到最近的國美黃光裕案,涉案的政府官員都是濫用權(quán)力,與不法企業(yè)或商人邪惡結(jié)合、共牟私利,普遍稱其為官商勾結(jié)。官商勾結(jié)型職務(wù)犯罪,不僅敗壞了黨和政府的威信,在廣大人民群眾中造成了惡劣影響,也嚴重妨礙了市場經(jīng)濟有序發(fā)展。本文將從官商勾結(jié)型職務(wù)犯罪的概念、特點、形成原因、危害性以及打擊此類犯罪的必要性出發(fā),通過將我國現(xiàn)行偵查手段和模式與他國進行分析、對比和研究,系統(tǒng)分析“官商勾結(jié)”型職務(wù)犯罪,初步探究該類犯罪的偵查策略、偵查手段及發(fā)展方向,以供在各偵查戰(zhàn)線上的偵查干警做參考。
[Abstract]:In recent years, whether from the Cheng Kejie corruption case to the Chen Liangyu corruption case, or to the recent Gome Wong Kwong Yu case, the government officials involved in the case have abused their power and have combined evil with illegal enterprises or businessmen to seek common self-interest. It is commonly referred to as collusion between government and business. The crime of official and commercial collusion not only destroys the prestige of the Party and the government, but also seriously hinders the orderly development of the market economy. Starting from the concept, characteristics, causes, harmfulness and the necessity of cracking down on this kind of crimes, this paper will analyze, compare and study the present investigative techniques and models with other countries. This paper systematically analyzes the duty crime of "collusion between government and business", and preliminarily probes into the investigation strategy, means and development direction of this kind of crime, so as to provide reference for investigating policemen on various investigation fronts.
