【摘要】： 本文通過(guò)理論分析的方法,首先在闡明責(zé)任、法律責(zé)任和行政責(zé)任三個(gè)上位概念的基礎(chǔ)上,指出警察執(zhí)法責(zé)任是指公安機(jī)關(guān)及其人民警察在執(zhí)法過(guò)程中,由于行政違法、行政不當(dāng),侵犯警察管理相對(duì)人的合法權(quán)益或者損害國(guó)家和社會(huì)公共利益所應(yīng)當(dāng)承擔(dān)的法律責(zé)任,進(jìn)而討論了警察執(zhí)法責(zé)任的構(gòu)成、類型和意義。 在闡明警察執(zhí)法責(zé)任概念和意義的基礎(chǔ)上,本文詳盡地考察了我國(guó)香港的警察執(zhí)法責(zé)任制度和美國(guó)、英國(guó)與法國(guó)等歐美主要國(guó)家警察的執(zhí)法監(jiān)督機(jī)制,發(fā)現(xiàn)和借鑒這些國(guó)家和地區(qū)警察執(zhí)法責(zé)任制度的優(yōu)點(diǎn)和經(jīng)驗(yàn)及其啟示,進(jìn)而考證了我國(guó)警察執(zhí)法責(zé)任制度的法律基礎(chǔ)和警察執(zhí)法責(zé)任的內(nèi)容等現(xiàn)狀,指出我國(guó)規(guī)定警察執(zhí)法責(zé)任的法律法規(guī)太少并且層次較低,追究警察執(zhí)法責(zé)任的程序不規(guī)范,追究警察執(zhí)法責(zé)任的過(guò)程和結(jié)果不公開(kāi)等警察執(zhí)法責(zé)任制度存在的問(wèn)題。 最后建議通過(guò)理念更新來(lái)完善警察執(zhí)法責(zé)任制度,通過(guò)改革警察管理體制,加強(qiáng)警察執(zhí)法監(jiān)督,嚴(yán)格追究違法警察的執(zhí)法責(zé)任,推行警察執(zhí)法責(zé)任制來(lái)改革和完善我國(guó)警察執(zhí)法責(zé)任的追究機(jī)制,實(shí)現(xiàn)以責(zé)限權(quán),追求警察執(zhí)法的權(quán)責(zé)一致。
[Abstract]:Through the method of theoretical analysis, first of all, on the basis of clarifying the three upper concepts of responsibility, legal responsibility and administrative responsibility, this paper points out that the responsibility of police law enforcement refers to that the public security organ and its people's police break the law because of administrative violation in the course of law enforcement. Improper administration infringes on the legitimate rights and interests of the relative party or damages the public interests of the state and society. The composition, types and significance of the law enforcement responsibility of the police are discussed. On the basis of expounding the concept and significance of police law enforcement responsibility, this paper makes a detailed study of the police law enforcement responsibility system in Hong Kong and the police law enforcement and supervision mechanisms of the major European and American countries, such as the United States, the United Kingdom and France, etc. Find and draw lessons from the advantages, experiences and enlightenment of the police law enforcement responsibility system of these countries and regions, and then verify the present situation of the legal basis of the police law enforcement responsibility system and the content of the police law enforcement responsibility in our country. It is pointed out that there are too few and low levels of laws and regulations for police law enforcement responsibility in our country, the procedure of investigating police law enforcement responsibility is not standardized, the process and result of investigating police law enforcement responsibility are not open, and so on, such as the problems existing in the police law enforcement responsibility system. Finally, it is suggested that the system of police law enforcement responsibility should be improved through the renewal of concepts, the police management system should be reformed, police law enforcement supervision should be strengthened, and the law enforcement responsibilities of illegal police should be strictly investigated. To carry out the police law enforcement responsibility system to reform and perfect the investigation mechanism of our country's police law enforcement responsibility, to realize the limitation of responsibility and to pursue the consistency of the power and responsibility of the police law enforcement.
