【摘要】： 未成年人犯罪問題是當前社會治安的一個突出問題。預(yù)防和減少未成年人犯罪,已成為世界各國所要共同面臨的問題。在刑事政策方面,各國一般更重視對未成年人犯罪的矯正與保護,努力淡化刑罰。未成年人社區(qū)矯正理念,是對未成年人社區(qū)矯正的應(yīng)然狀態(tài)的理性認識。如何更加有效地推進未成年犯社區(qū)矯正的深入對我國傳統(tǒng)的刑罰執(zhí)行理念與方法提出了新的要求,即究竟應(yīng)該“以什么樣的觀念和方法來滿足未成年犯社區(qū)矯正實踐的需要”?本文第一章提出了法律應(yīng)該對未成年人給予特殊保護的觀點,并介紹了社區(qū)矯正對于未成年犯罪人的重要意義;第二章通過對不同執(zhí)法理念的比較和未成年人社區(qū)矯正現(xiàn)狀的分析,指出未成年人社區(qū)矯正正確理念確立的重大意義;第三章介紹了美、英、新西蘭等國家未成年人社區(qū)矯正制度及理念的發(fā)展情況及經(jīng)驗做法;第四章分析了影響確定我國未成年人社區(qū)矯正理念的因素,指出我國未成年人社區(qū)矯正的制度缺陷;第五章對完善我國未成年人社區(qū)矯正體系提出了建議。
[Abstract]:The problem of juvenile delinquency is a prominent problem in the current social security. Prevention and reduction of juvenile delinquency has become a common problem for all countries in the world. In criminal policy, all countries pay more attention to the correction and protection of juvenile delinquency and try to weaken the punishment. The concept of minor community correction is a minor to minors. The rational understanding of the deserved state of the community corrections. How to further promote the deepening of the community correction of the juvenile delinquents has put forward new demands on the traditional concept and method of the execution of the penalty in our country, namely, what kind of concept and method should be "to meet the needs of the community correction practice of the minor offenders"? The first chapter of this paper is proposed. The law should give special protection to minors, and introduce the significance of community correction to juvenile delinquency. The second chapter points out the significance of the establishment of the correct concept of the minor community correction through the comparison of different law enforcement concepts and the present situation of the minor community correction. The third chapter introduces the beauty and the British, The development and experience of community correction system and ideas of minors in New Zealand and other countries; the fourth chapter analyses the factors that affect the concept of community correction in China's minors, and points out the institutional defects of the community correction of minors in our country, and the fifth chapter puts forward some suggestions on improving the community correction system of the minor people in our country.
