電動自行車的社會規(guī)制困境與對策研究

【摘要】: 電動自行車產(chǎn)業(yè)是我國的原創(chuàng)產(chǎn)業(yè)、低碳產(chǎn)業(yè)。從2003年至今,經(jīng)過短短幾年的發(fā)展,電動自行車產(chǎn)業(yè)已成為一個擁有眾多自主知識產(chǎn)權(quán)、產(chǎn)業(yè)規(guī)模超千億元的新興產(chǎn)業(yè)。在能源供應(yīng)持續(xù)緊張,環(huán)保呼聲日益高漲的今天,電動自行車作為適合短途使用的個人交通工具,以其零排放、低噪音、方便快捷、經(jīng)濟實用等優(yōu)點受到了越來越多的消費者的喜愛,產(chǎn)業(yè)規(guī)模迅速壯大。隨著電動自行車自身技術(shù)的日趨成熟,車輛的性價比也在不斷提升,電動自行車的產(chǎn)銷量呈逐年快速增長的態(tài)勢。在歐洲、美國、日本等發(fā)達國家和地區(qū),電動自行車雖然不是主要交通工具,但是,受油價上漲和環(huán)保意識增強等因素的影響,許多國家和地區(qū)對電動自行車的發(fā)展非常關(guān)注,相繼出臺了一系列支持電動自行車發(fā)展的法規(guī)及標準,以規(guī)范和支持電動自行車的生產(chǎn)。但是,在我國的電動自行車的社會規(guī)制中,由于法律不健全、標準之間的沖突、違法行政等因素的影響,電動自行車在生產(chǎn)、銷售、使用等方面屢屢遭遇困境。為突破這些困境,首先要建立健全聽證制度,完善立法和標準制定程序;其次,引入社會契約制度,鼓勵企業(yè)在規(guī)制框架內(nèi)生產(chǎn);第三,要提高依法行政水平,構(gòu)建高效、和諧交通;最后,要強化交通法規(guī)教育,倡導安全、綠色出行。
[Abstract]:Electric bicycle industry is our country's original industry, low-carbon industry. Since 2003, after a few years of development, the electric bicycle industry has become a new industry with many independent intellectual property rights and a scale of more than 100 billion yuan. Today, when the energy supply continues to be tight and environmental protection is growing, the electric bicycle, as a personal vehicle suitable for short distance transportation, has zero emissions, low noise, and is convenient and fast. Economic and practical advantages by more and more consumers like, the scale of the industry grew rapidly. With the development of electric bicycle technology, the performance and price ratio of the vehicle is improving, and the production and sales of the electric bicycle are increasing rapidly year by year. In Europe, the United States, Japan, and other developed countries and regions, although electric bikes are not the main means of transportation, many countries and regions are very concerned about the development of electric bikes, due to factors such as rising oil prices and increasing awareness of environmental protection. In order to standardize and support the production of electric bicycle, a series of laws and standards have been issued to support the development of electric bicycle. However, in the social regulation of electric bicycle in our country, due to the imperfect law, the conflict between standards, illegal administration and other factors, the production, sale and use of electric bicycle often encounter difficulties. In order to break through these difficulties, first of all, we should establish and perfect the hearing system, perfect the legislation and standard-setting procedures; secondly, introduce the social contract system to encourage enterprises to produce within the framework of regulation; third, improve the level of administration according to law and build an efficient system. Harmonious traffic; finally, to strengthen the education of traffic laws and regulations, promote safety, green travel.
