【摘要】：在當(dāng)前我國(guó)社會(huì)轉(zhuǎn)型過(guò)程中,職務(wù)犯罪的滋生和蔓延給社會(huì)的發(fā)展造成了非常嚴(yán)重的后果,成為現(xiàn)實(shí)中亟待解決的問(wèn)題,而隸屬于司法機(jī)關(guān)的監(jiān)獄民警職務(wù)犯罪危害尤甚。監(jiān)獄民警職務(wù)犯罪研究采用刑法學(xué)標(biāo)準(zhǔn),職務(wù)犯罪的領(lǐng)域主要分布在執(zhí)法權(quán)和行政監(jiān)管權(quán)兩大塊,可以分成貪利型、瀆職型和侵犯人身權(quán)利型三種。在監(jiān)獄管理體制改革的背景下,監(jiān)獄機(jī)關(guān)采取了一系列舉措來(lái)防范和控制民警職務(wù)犯罪,并收到了一定的效果,但也存在諸多不足和問(wèn)題。監(jiān)獄民警職務(wù)犯罪不僅呈現(xiàn)出多樣化的特征,而且演變的態(tài)勢(shì)也呈現(xiàn)出一定的規(guī)律性。造成監(jiān)獄民警職務(wù)犯罪的原因是多方面的,既有宏觀(guān)和微觀(guān)層面的原因,又有客觀(guān)和主觀(guān)方面的原因,也有社會(huì)、監(jiān)獄和民警個(gè)人方面的原因。在全面解讀和深層把握民警職務(wù)犯罪原因的基礎(chǔ)上,深入推進(jìn)監(jiān)獄民警職務(wù)犯罪防范與控制路徑研究。路徑研究應(yīng)遵循這樣的理念：不僅要涵蓋對(duì)以往我國(guó)監(jiān)獄民警職務(wù)犯罪狀況的反思、總結(jié)、借鑒,還應(yīng)包括結(jié)合社會(huì)發(fā)展遠(yuǎn)景和監(jiān)獄民警職務(wù)犯罪的演變趨勢(shì),進(jìn)行機(jī)制、制度、方法、結(jié)構(gòu)等層面創(chuàng)新的思考。
[Abstract]:In the process of social transformation in our country, the breeding and spreading of job-related crimes have caused very serious consequences to the development of the society and become a problem to be solved urgently in reality, especially the crimes committed by prison police officers belonging to the judicial organs. The research on the post crime of prison police adopts the standard of criminal law. The field of duty crime is mainly divided into three types: law enforcement power and administrative supervision power, which can be divided into three types: embezzlement, dereliction of duty and violation of personal rights. Under the background of the reform of prison management system, the prison authorities have taken a series of measures to prevent and control the police duty crime, and have received certain results, but there are also many shortcomings and problems. The prison police duty crime not only presents the diversified characteristic, but also presents certain regularity. There are many reasons for the crime of prison police duty, both macroscopic and microcosmic, objective and subjective, and social, prison and police personal reasons. On the basis of comprehensive understanding and deep understanding of the causes of the crimes committed by the police officers, the research on the prevention and control path of the crimes committed by the police officers in the prison is carried out in depth. The path study should follow the following ideas: not only to reflect on the past situation of prison police duty crime in China, but also to sum up and learn from it, and also to combine the social development perspective and the evolution trend of prison police duty crime, and carry on the mechanism. System, method, structure and other levels of innovation thinking.
