論我國(guó)勞動(dòng)教養(yǎng)替代制度的構(gòu)建

【摘要】: 盡管還有爭(zhēng)論,但勞動(dòng)教養(yǎng)的廢除看來(lái)已經(jīng)是大勢(shì)所趨的事情了,勞動(dòng)教養(yǎng)作為一項(xiàng)獨(dú)具中國(guó)特色的社會(huì)管理手段,雖然因?yàn)槠渲贫壬系娜毕菖c當(dāng)前的我國(guó)法治化進(jìn)程相沖突,但不可否認(rèn)的是,勞動(dòng)教養(yǎng)制度長(zhǎng)期以來(lái)在維護(hù)社會(huì)治安,管理社會(huì)秩序方面,發(fā)揮了重要的作用。有鑒于此,現(xiàn)在應(yīng)該著手進(jìn)行法律制度上的設(shè)計(jì),找到一種替代的手段,使勞動(dòng)教養(yǎng)制度廢除后所留下的法律方面空白不至于帶來(lái)社會(huì)管理上的混亂。 在目前改革勞動(dòng)教養(yǎng)制度的討論中,有行政化、獨(dú)立化、犯罪化、保安處分化等四種思路,都站在各自解讀勞動(dòng)教養(yǎng)的不同角度提出了看法和解決方案,四種思路都有明顯的缺陷,具體操作的難度很大。筆者認(rèn)為一種比較可行的辦法是,在勞動(dòng)教養(yǎng)替代制度設(shè)計(jì)上走社會(huì)化的模式,充分發(fā)揮社區(qū)組織和NGO的重要作用,走一條“社區(qū)為主,NGO(非政府組織)參與,國(guó)家監(jiān)督,自愿教育和強(qiáng)制教育相結(jié)合,多元多層次的”行為矯正的道路。如果這一做法得到實(shí)現(xiàn)的話,將一方面有利于我國(guó)真正意義上的法治社會(huì)的建立,另一方面也有助于節(jié)約政府有限的行政資源,取得最佳的社會(huì)效果。 本文由前言、主文、和結(jié)論組成,主文分五部分。 第一部分對(duì)勞動(dòng)教養(yǎng)制度進(jìn)行綜述。 第二部分分析在我國(guó)現(xiàn)階段構(gòu)建勞動(dòng)教養(yǎng)替代制度的必要性。主要從市場(chǎng)經(jīng)濟(jì)和城市化的要求,維護(hù)社會(huì)秩序的需要,解決法律銜接的要求等方面論述。 第三部分對(duì)國(guó)外與我國(guó)勞動(dòng)教養(yǎng)制度相關(guān)的制度進(jìn)行介紹,并提出對(duì)我國(guó)的借鑒意義。主要有保安處分制度、輕罪制度和少年司法制度等。 第四部分對(duì)勞動(dòng)教養(yǎng)已有的改革思路進(jìn)行介紹并作出評(píng)析。 第五部分提出構(gòu)建社會(huì)化模式替代制度的新設(shè)想,分析其可行性,并介紹其具體內(nèi)容。
[Abstract]:Although there are still arguments, the abolition of re-education through labour seems to have become a general trend. As a unique social management means with Chinese characteristics, reeducation through labour, although its institutional defects conflict with the current process of rule of law in China,But it is undeniable that the system of reeducation through labor has played an important role in maintaining public order and managing social order for a long time.In view of this, it is time to proceed with the design of the legal system and find an alternative means so that the legal gaps left by the abolition of the re-education through labour system will not lead to confusion in social management.In the current discussion on the reform of the re-education through labour system, there are four ways of thinking: administrative, independent, criminalized, and division of the Security Branch. They all put forward their views and solutions from different angles of interpreting the reeducation through labor.Four kinds of train of thought all have the obvious flaw, the concrete operation is very difficult.The author thinks that a more feasible way is to take the mode of socialization in the design of the alternative system of re-education through labor, give full play to the important role of community organizations and NGO, and take a "community-oriented participation of NGO (non-governmental organizations) and state supervision."Voluntary education and compulsory education combined, multi-level "behavior correction road."If this practice is realized, it will be beneficial to the establishment of our country's real sense of rule of law on the one hand, on the other hand, it will also help to save the limited administrative resources of the government and obtain the best social effect.This paper consists of preface, main text, and conclusion, which is divided into five parts.The first part summarizes the system of reeducation through labor.The second part analyzes the necessity of constructing the system of reeducation through labor at present in our country.This paper mainly discusses the requirements of market economy and urbanization, the need of maintaining social order, and the requirement of legal convergence.The third part introduces the foreign institutions related to our country's reeducation through labor system, and puts forward the reference significance to our country.There are mainly security measures system, misdemeanor system and juvenile justice system.The fourth part introduces and evaluates the existing reform ideas of reeducation through labor.In the fifth part, the author puts forward a new idea of constructing the socialized model substitution system, analyzes its feasibility, and introduces its concrete contents.
