【摘要】： 我們在研究當(dāng)前糾紛解決的現(xiàn)狀時,發(fā)現(xiàn)一個很普遍而又被廣大法學(xué)研究者所忽略的現(xiàn)實(shí)存在:許多糾紛特別是相當(dāng)數(shù)量的民間糾紛,是在基層派出所消化解決掉的。如果這些糾紛不經(jīng)公安機(jī)關(guān)的“過濾”而直接涌向基層法院,則目前的基層法院將不堪重負(fù)�？梢�,在實(shí)然層面上,公安機(jī)關(guān)在糾紛解決中的作用是顯而易見的。但是,“基層派出所在民間糾紛的解決和基層司法的系統(tǒng)中具有至關(guān)重要的作用,卻很少引起法學(xué)界的重視”。①筆者在一城市基層派出所工作,工作中面對由民警出面解決各類糾紛的現(xiàn)狀本來已習(xí)以為常,即認(rèn)為此種狀況“本來就是如此”。但隨著對各種糾紛解決機(jī)制研究的深入,發(fā)現(xiàn)公安機(jī)關(guān)解決糾紛的狀況并非“本來就是如此”這么簡單。有許多問題在實(shí)際參與糾紛解決的當(dāng)事人和學(xué)界當(dāng)中都存在疑惑與爭論。公安機(jī)關(guān)作為行政機(jī)關(guān)介入糾紛解決,不可避免地會引起公權(quán)力與私權(quán)利、強(qiáng)制與自治之間的緊張關(guān)系。公安機(jī)關(guān)在糾紛解決中的作用、介入糾紛的限度、公安糾紛解決與訴訟等其他糾紛解決機(jī)制間的關(guān)系以及對公安行政權(quán)力的控制等等,都是可在法學(xué)理論基礎(chǔ)上作深入探討的社會現(xiàn)實(shí)問題。在對以派出所為代表的公安解決糾紛的現(xiàn)狀、原因進(jìn)行客觀描述和實(shí)證分析的基礎(chǔ)上,筆者想就公安機(jī)關(guān)在糾紛解決中的作用及其評價,公安解決糾紛的方式和過程、與其他糾紛解決機(jī)制間的關(guān)系等問題進(jìn)行探討;進(jìn)而對公安糾紛解決中存在的問題與制度的完善等問題進(jìn)行理論論證和制度分析。
[Abstract]:When we study the present situation of dispute resolution, we find a very common reality which is ignored by the majority of law researchers: many disputes, especially a considerable number of civil disputes, are digested and resolved in the grass-roots police stations.If these disputes flow directly to the grassroots courts without the "filtering" of the public security organs, the current grassroots courts will be overwhelmed.Therefore, on the level of reality, the role of public security organs in dispute resolution is obvious.However, "the grass-roots police stations play a vital role in the settlement of civil disputes and the judicial system at the grass-roots level, but rarely attract the attention of the legal community." .1 the author works in a city's grass-roots police station.In the face of the police to resolve all kinds of disputes has become accustomed to the situation, that is, "this is the original situation."However, with the thorough study of various dispute resolution mechanisms, it is found that the situation of public security organs in resolving disputes is not so simple as originally.There are many problems in the parties and academic circles involved in dispute resolution.The public security organ, as an administrative organ, will inevitably cause tension between public power and private right, compulsion and autonomy.The role of public security organs in dispute resolution, the limits of intervention in disputes, the relationship between public security dispute resolution and other dispute resolution mechanisms such as litigation, and the control of public security administrative powers, etc.Both are social and realistic problems that can be discussed in depth on the basis of legal theory.On the basis of the objective description and empirical analysis of the present situation and the reasons of the police station's dispute resolution, the author would like to discuss the role and evaluation of the public security organ in the dispute resolution, and the way and process of the public security to resolve the dispute.The relationship between the system and other dispute settlement mechanisms is discussed, and the problems existing in the public security dispute resolution and the perfection of the system are discussed in theory and system analysis.
