【摘要】：社區(qū)矯正是行刑社會(huì)化、人道化的必然表現(xiàn)形式,在刑罰謙抑性思想和"預(yù)防犯罪、減少犯罪、化解矛盾、促進(jìn)和諧"的刑事法律制度和行刑理念的推動(dòng)下,兩高兩部聯(lián)合下發(fā)了《關(guān)于開展社區(qū)矯正試點(diǎn)工作的通知》,各地?fù)?jù)此開展了社區(qū)矯正的實(shí)踐。陜西省于2010年全面推行了社區(qū)矯正工作試點(diǎn),在此期間,由于各項(xiàng)基本條件的限制,公檢法司配合協(xié)調(diào)不到位,群眾認(rèn)同度不高,又缺乏法律依據(jù),使得此項(xiàng)工作的推進(jìn)受到很大的制約。為此,需要完善相關(guān)立法,確定編制機(jī)構(gòu)和保障經(jīng)費(fèi),做好宣傳教育工作,提高人們的思想認(rèn)識(shí),做好公檢法司各方的配合、協(xié)調(diào),有效推進(jìn)社區(qū)矯正工作,保證刑事法律制度和行刑理念的落實(shí)。
