【摘要】：社會(huì)調(diào)查制度是運(yùn)用于未成年人刑事案件中,旨在通過對(duì)未成年人相關(guān)因素的調(diào)查反映未成年人實(shí)施犯罪行為的內(nèi)在原因,而所調(diào)查的與未成年人相關(guān)的因素就是社會(huì)調(diào)查報(bào)告的內(nèi)容。社會(huì)調(diào)查報(bào)告內(nèi)容是社會(huì)調(diào)查制度的重要環(huán)節(jié),調(diào)查內(nèi)容的準(zhǔn)確性與科學(xué)性決定了社會(huì)調(diào)查制度能否有效地的運(yùn)行。以發(fā)現(xiàn)未成年人犯罪原因?yàn)槟康拇_立的社會(huì)調(diào)查報(bào)告內(nèi)容,其理論依據(jù)也應(yīng)與未成年人犯罪原因論相一致。目前我國通過對(duì)未成年人各方面的因素進(jìn)行調(diào)查,總是不加分別的作為罪輕的依據(jù),而忽視了未成年人犯罪原因的分析,使調(diào)查內(nèi)容膚淺且形式化。 文章主體以社會(huì)調(diào)查報(bào)告應(yīng)調(diào)查的內(nèi)容為核心問題,從以下四個(gè)方面展開研討。 首先,該部分從社會(huì)調(diào)查制度入手引出本文研究的核心,即社會(huì)調(diào)查報(bào)告內(nèi)容,論述了研究社會(huì)調(diào)查報(bào)告內(nèi)容的價(jià)值,分析了與社會(huì)調(diào)查報(bào)告內(nèi)容相聯(lián)系的未成年人犯罪原因論的國內(nèi)外相關(guān)理論,以及關(guān)于社會(huì)調(diào)查報(bào)告內(nèi)容的國內(nèi)外相關(guān)法律規(guī)定,進(jìn)而分析社會(huì)調(diào)查報(bào)告內(nèi)容存在的問題。 其次,分述家庭因素作為社會(huì)調(diào)查報(bào)告內(nèi)容的主要方面,通過對(duì)家庭結(jié)構(gòu)、教育方式等方面進(jìn)行調(diào)查,分析在未成年人實(shí)施犯罪行為時(shí),家庭方面的原因。 然后,分述學(xué)校教育因素作為社會(huì)調(diào)查報(bào)告內(nèi)容的主要方面,在未成年人實(shí)施犯罪行為中存在的消極因素。學(xué)校教育形式、方法、管理等漏洞都會(huì)對(duì)未成年人犯罪行為產(chǎn)生影響。 最后,分述其他一些因素作為社會(huì)調(diào)查報(bào)告內(nèi)容的方面,在未成年人實(shí)施犯罪行為中存在的消極因素。如不良的社區(qū)環(huán)境、不良交往以及其他未成年人自身存在的消極特征也是造成未成年人犯罪行為發(fā)生的原因。
[Abstract]:The social investigation system is used in juvenile criminal cases to reflect the inherent causes of juvenile delinquency through the investigation of relevant factors of minors.The factors related to minors investigated are the contents of the social investigation report.The content of the social investigation report is an important link in the social investigation system. The accuracy and scientific nature of the investigation content determine whether the social investigation system can operate effectively.The theoretical basis of the social investigation report, which is established for the purpose of discovering the causes of juvenile delinquency, should be consistent with the theory of the causes of juvenile delinquency.At present, through the investigation of various factors of minors in our country, we always ignore the analysis of the causes of juvenile delinquency and neglect the analysis of the causes of juvenile delinquency, which makes the investigation content superficial and formalized.The main body of the article focuses on the contents of the social investigation report and discusses the following four aspects.First of all, this part draws the core of this study from the social investigation system, that is, the content of the social investigation report, and discusses the value of the study of the social investigation report.This paper analyzes the related theories of juvenile delinquency theory related to the contents of social investigation report, and the relevant legal provisions about the contents of social investigation reports at home and abroad, and then analyzes the problems existing in the contents of social investigation reports.Secondly, the family factors as the main aspects of the social investigation report, through the investigation of the family structure, education methods and other aspects, this paper analyzes the causes of juvenile delinquency.Then, as the main aspect of the social investigation report, the factors of school education exist negative factors in juvenile delinquency.School education forms, methods, management and other loopholes will have an impact on juvenile delinquency.Finally, some other factors as the content of social investigation report, the existence of negative factors in juvenile delinquency.Such as bad community environment, bad communication and negative characteristics of other minors themselves are also the causes of juvenile delinquency.
