【摘要】：對東莞地區(qū)五年來1650件重大刑事案件的犯罪類型、犯罪性質(zhì)、犯罪主體情況及其家庭結(jié)構、經(jīng)濟狀況以及刑事被害人被害事實進行調(diào)查分析,發(fā)現(xiàn)目前刑事法律規(guī)定的對刑事被害人損失進行救濟的手段作用非常有限,絕大多數(shù)刑事被害人根本無法得到救濟。這不僅使刑事判決不能滿足日益增長的刑事被害人群體的司法需求,也影響到司法判決的法律效果與社會效果,更加深了刑事被害人作為維權的弱勢群體與政府或國家機關之間的矛盾,引發(fā)出刑事政策觀念層次的矛盾和沖突。在刑事被告人經(jīng)濟能力有限刑事被害人獲賠落空的情況下,由國家對刑事被害人弱勢群體進行救濟就顯得特別必要。
[Abstract]:To investigate and analyze the types of crimes, the nature of the crime, the main body of the crime and its family structure, the economic situation and the fact that the criminal victims have been killed in 1650 major criminal cases in Dongguan in the past five years.It is found that the current criminal law provides a very limited means to remedy the loss of criminal victims, most of the criminal victims simply can not get relief.This not only makes the criminal judgment unable to meet the judicial needs of the growing group of criminal victims, but also affects the legal and social effects of the judicial decision.It also deepens the contradiction between the criminal victim as the vulnerable group and the government or state organ, which leads to the contradiction and conflict of the concept of criminal policy.In the case of the criminal defendant's limited financial ability and the failure of the criminal victim's compensation, it is particularly necessary for the state to provide relief to the vulnerable group of the criminal victim.
