【摘要】： 本文探討的是血液制品犯罪引發(fā)的刑法問題。血液制品是治病救人的良藥,因其原料來自健康人的血液而有著區(qū)別于其他藥品的特性,其生產(chǎn)包括采集原料血漿與投料生產(chǎn)兩部分。人們熟知的義務(wù)獻血的血液與血液制品有著本質(zhì)的區(qū)別,本文的研究僅限于血液制品犯罪。血液制品犯罪的后果通常是造成大量供血者或受血者感染艾滋病、肝炎等經(jīng)血液傳播的疾病,嚴(yán)重危害公共衛(wèi)生安全。因此無論是規(guī)范血液制品生產(chǎn)的行政法規(guī),還是處罰血液制品犯罪的刑法,都無一例外的強調(diào)了血液制品生產(chǎn)主體的特殊和規(guī)范的嚴(yán)格。然而,當(dāng)前血液制品行業(yè)尚未發(fā)展成熟,利益的驅(qū)動和監(jiān)管的疏漏都增加了血液制品的不安全因素,并屢屢出現(xiàn)震驚社會的大案要案。97年刑法修改時雖然新增了血液制品的相關(guān)罪名,但效果并不顯著,血液制品違法犯罪行為依然猖獗。因此有必要深入研究血液制品犯罪的特點、法律適用以及立法的缺陷。 本文約六萬字,主體結(jié)構(gòu)包括三個部分: 第一部分是對血液制品的概括介紹,也就是第一章。包括血液制品的概念、血液制品行業(yè)的現(xiàn)狀、血液制品違法犯罪行為以及危害性的考查。本部分主要是介紹性質(zhì),并涉及較多的血液制品專業(yè)知識。 第二部分主要論述血液制品違法犯罪行為的法律適用,包括第二至四章,是核心部分。第二章是血液制品違法犯罪行為的整體法律制裁體系,分別介紹了民法、行政法和刑法的規(guī)定。第三章以較大的篇幅深入分析刑法第三百三十四條的結(jié)構(gòu)特征以及司法認(rèn)定的疑難問題。第四章則更深入一個層次,結(jié)合著名案例對血液制品犯罪罪名體系的法律適用進行思考與分析。 第三部分是立法完善,為本文的第五章內(nèi)容。該部分以前四章為基礎(chǔ),總結(jié)刑法第三百三十四條的立法缺陷并提出立法修改的建議。最后與第二章中現(xiàn)行法律制裁體系的缺陷相對應(yīng)提出對罪名體系的立法完善建議。
[Abstract]:This paper discusses the problem of criminal crime caused by blood products. Blood products are life-saving medicine, because of its raw materials from the blood of healthy people and has a characteristic different from other drugs, including the acquisition of raw materials and the production of plasma feed production in two. Known as the blood donation of blood and blood products are essentially the difference, this study is limited to blood products, blood products the consequences of crime. Crime is usually caused by a large number of HIV infected donors or recipients, hepatitis and other blood borne diseases, serious harm to public health and safety. Because this is both normative blood products or administrative regulations, the criminal punishment of the criminal law are blood products. Without exception, emphasize the production of blood products and special subject standard strictly. However, the blood products industry is not yet mature, driven by the interests and supervision of dredging The leakage increases the safety factor of blood products, and appeared shocked society of major cases in.97 while the new criminal law related charges of blood products, blood products, but the effect is not significant, illegal and criminal activities are still rampant. So it is necessary to deeply research the features of blood products crime, law and legislative defects.
This article is about sixty thousand words, and the main body structure consists of three parts.
The first part is the introduction of blood products, which is the first chapter. Including the concept of blood products, blood products industry status quo, blood products of illegal and criminal behavior and examine the harmfulness. This part mainly introduces the properties, and involve more blood products professional knowledge.
The second part mainly discusses the application of blood products crime law, including the second chapter to the four chapter, is the core part. The second chapter is the blood products crime overall legal sanctions system, introduces provisions of civil law, administrative law and criminal law. The third chapter is devoted to the larger in-depth analysis of structural characteristics of article 334th of the criminal law and judicial determination of the difficult problems. The fourth chapter is a more in-depth level, combined with the famous case for charges of blood products crime system law of reflection and analysis.
The third part is the perfection of legislation, for the fifth chapter. This part is based on the previous four chapters, summarizes the legislative defects of article 334th of the criminal law and put forward legislative suggestions. Finally, modify and defect in the second chapter, the current system of legal sanctions should be made for the relative charge system of legislative proposals.
