【摘要】： 犯罪心理測(cè)試技術(shù)是一項(xiàng)新興的先進(jìn)司法應(yīng)用技術(shù)。此項(xiàng)技術(shù)主要運(yùn)用心理學(xué)與生理學(xué)中的“刺激——反應(yīng)”原理,通過(guò)檢測(cè)被測(cè)人有無(wú)涉案的犯罪心理痕跡,達(dá)到區(qū)分作案者與無(wú)辜者的目的。傳統(tǒng)的“測(cè)謊”假說(shuō)并不科學(xué)。目前,犯罪心理測(cè)試技術(shù)主要運(yùn)用于我國(guó)刑事司法領(lǐng)域,尤其在偵查階段發(fā)揮著重要作用。盡管此項(xiàng)技術(shù)具有一定的局限性,但其原理的科學(xué)性與結(jié)論的可靠性已得到實(shí)踐的證實(shí)。 在肯定犯罪心理測(cè)試技術(shù)價(jià)值的基礎(chǔ)上,進(jìn)一步分析測(cè)試結(jié)論的證據(jù)屬性問(wèn)題。犯罪心理測(cè)試結(jié)論具有證據(jù)資格,本質(zhì)上應(yīng)當(dāng)屬于“鑒定結(jié)論”的范疇。就其證明力而言,犯罪心理測(cè)試結(jié)論不僅可以用來(lái)審查判斷其他證據(jù)的真實(shí)性,它同樣可以作為認(rèn)定案件事實(shí)的依據(jù)。特別是當(dāng)測(cè)試結(jié)論認(rèn)定被測(cè)人是無(wú)辜者時(shí),法院據(jù)此可以做出宣告被告人無(wú)罪的判決。但在認(rèn)定被告人有罪方面,還需與其他證據(jù)結(jié)合起來(lái)共同認(rèn)定案件事實(shí)。 由于現(xiàn)行法律的模糊與行業(yè)標(biāo)準(zhǔn)的欠缺,導(dǎo)致犯罪心理測(cè)試技術(shù)在司法實(shí)踐運(yùn)用中出現(xiàn)混亂,此外,從犯罪心理測(cè)試主體、測(cè)試儀器、測(cè)試環(huán)境、測(cè)試程序等方面都處于一種無(wú)序狀態(tài)。針對(duì)這些問(wèn)題,應(yīng)當(dāng)從立法完善與技術(shù)操作角度加以規(guī)范。諸如需要立法明確犯罪心理測(cè)試結(jié)論的證據(jù)屬性,賦予測(cè)試人員與鑒定人同等的法律地位,加強(qiáng)測(cè)試技術(shù)行業(yè)管理等方面,從而促進(jìn)此項(xiàng)技術(shù)早日得到規(guī)范化應(yīng)用與健康發(fā)展。
[Abstract]:Criminal psychology testing technology is a new advanced judicial application technology.This technique mainly uses the principle of "stimulus-response" in psychology and physiology to distinguish between the perpetrator and the innocent by detecting whether the person involved in the crime has criminal psychological trace or not.The traditional lie detector hypothesis is not scientific.At present, the criminal psychology test technology is mainly used in the field of criminal justice in China, especially in the phase of investigation plays an important role.Although this technique has some limitations, the scientific nature of its principle and the reliability of its conclusion have been proved by practice.On the basis of affirming the technical value of criminal psychological test, this paper further analyzes the evidence attribute of the test conclusion.The conclusion of criminal psychological test has the qualification of evidence and should belong to the category of "appraisal conclusion" in essence.As far as its proof is concerned, the conclusion of criminal psychological test can not only be used to examine and judge the authenticity of other evidence, but also as the basis for determining the facts of the case.Especially when the test concludes that the subject is innocent, the court can acquit the defendant accordingly.But in the aspect of finding the defendant guilty, it is necessary to combine with other evidence to identify the facts of the case.Due to the ambiguity of the current law and the lack of industry standards, there is confusion in the application of criminal psychology testing technology in judicial practice. In addition, from the subject of criminal psychology test, the test instrument, the test environment,Testing procedures and other aspects are in a state of disorder.In view of these problems, we should standardize them from the angle of legislative perfection and technical operation.For example, it is necessary to legislate to clarify the evidence attribute of the conclusion of criminal psychological test, to endow the testers with the same legal status as the connoisseur, to strengthen the management of the testing technology and so on, so as to promote the standardized application and healthy development of this technology as soon as possible.
