論我國(guó)勞動(dòng)教養(yǎng)制度的司法性改造問(wèn)題

【摘要】: 勞動(dòng)教養(yǎng)初創(chuàng)于20世紀(jì)50年代我國(guó)的肅反運(yùn)動(dòng)期間,發(fā)展于1978年之后。50多年來(lái),該制度在維護(hù)社會(huì)治安,預(yù)防和減少犯罪,教育和挽救輕微違法犯罪人員等方面起到了積極的作用。但隨著我國(guó)社會(huì)、經(jīng)濟(jì)、政治、文化等方面的發(fā)展,其存在的一些問(wèn)題和缺陷亦日益凸顯,并在中外法學(xué)界引起了較大的爭(zhēng)議。特別是收容遣送制度廢除后,勞動(dòng)教養(yǎng)制度何去何從的問(wèn)題一時(shí)間被推到了風(fēng)口浪尖,再次成為一個(gè)引人注目的焦點(diǎn)。因此,對(duì)現(xiàn)行的勞動(dòng)教養(yǎng)制度進(jìn)行必要的改革,既能適應(yīng)21世紀(jì)新形勢(shì)下與輕微違法行為作斗爭(zhēng)的需要,又符合我國(guó)的社會(huì)主義法治理念,而且能為維護(hù)社會(huì)穩(wěn)定,保障社會(huì)主義經(jīng)濟(jì)建設(shè)和構(gòu)建社會(huì)主義和諧社會(huì)作出更大的貢獻(xiàn)。 本文首先閘述了勞動(dòng)教養(yǎng)制度的歷史沿革及現(xiàn)狀,進(jìn)而通過(guò)對(duì)勞動(dòng)教養(yǎng)制度的反思,從合理性和缺陷性兩方面對(duì)其進(jìn)行了全面的分析,并結(jié)合當(dāng)前勞動(dòng)教養(yǎng)制度的存廢之爭(zhēng),得出了勞動(dòng)教養(yǎng)制度改革勢(shì)在必行的觀點(diǎn),最后對(duì)勞動(dòng)教養(yǎng)制度的司法性改造進(jìn)行了深入的論述并提出了具體的建議和措施。本文嘗試通過(guò)理論與實(shí)踐的結(jié)合,探討我國(guó)的勞動(dòng)教養(yǎng)制度的改革與完善,以使其在我國(guó)社會(huì)主義法治進(jìn)程中發(fā)揮更為積極有效的作用。
[Abstract]:During the Anti-Rebellion Movement in the 1950s and after 1978, the reeducation through labor system was established in order to maintain public order and to prevent and reduce crime.Education and rescue of minor offenders and other aspects played a positive role.However, with the development of our society, economy, politics, culture and so on, some problems and defects have become increasingly prominent, and have aroused great controversy in the field of law at home and abroad.Especially after the abolition of the system of reception and repatriation, the question of what to do with the system of re-education through labour has been pushed to the forefront of the storm and has once again become the focus of attention.Therefore, the necessary reform of the current system of re-education through labour can not only meet the needs of the struggle against minor illegal acts in the new situation of the 21st century, but also conform to the socialist concept of the rule of law in our country, and also be able to maintain social stability.To ensure socialist economic construction and build a socialist harmonious society to make greater contributions.This paper first describes the historical evolution and current situation of the reeducation through labor system, and then through the reflection of the system of re-education through labor, from the rationality and defect of two aspects, and combined with the current struggle for the retention and abolition of the system of re-education through labor.Finally, the author discusses the judicial reform of the reeducation through labor system and puts forward some concrete suggestions and measures.Through the combination of theory and practice, this paper attempts to probe into the reform and perfection of our country's reeducation through labor system, so as to make it play a more active and effective role in the process of socialist rule of law in our country.
