【摘要】：社區(qū)矯正制度的建立,是一種以人道主義精神為基礎的刑罰改革,體現了刑罰輕刑化、社會化的時代趨勢。社區(qū)矯正作為非監(jiān)禁刑罰執(zhí)行方式在我國全面推進以來,在增強刑罰效能,降低行刑成本,避免服刑人員交叉感染以及形成監(jiān)獄化社會人格等方面發(fā)揮了重要的作用,社區(qū)矯正工作隊伍也逐步形成并發(fā)揮著舉足輕重的作用。一項工作的有效開展,離不開工作隊伍的建設。目前我國社區(qū)矯正隊伍的建設模式和管理考核機制還處于起步階段,還在實踐中不斷地探索和修改完善之中,因此研究社區(qū)矯正隊伍建設,對提升社區(qū)矯正工作水平,激發(fā)社區(qū)矯正工作者的工作熱情,提高社區(qū)矯正工作效率和執(zhí)法規(guī)范化水平來說可謂意義深遠。隨著經濟社會的不斷發(fā)展,社區(qū)服刑人員不斷增加,社區(qū)矯正工作對社區(qū)矯正工作者的數量要求也會逐漸加大,素質要求逐漸提高,社區(qū)矯正隊伍建設方面存在的問題和不足也隨之越來越明顯。本文主要以人力資源發(fā)展和公共治理理論為基礎,以四川省X縣為個案展開分析。全文共分為五個部分:引言部分在社區(qū)矯正隊伍建設的研究背景和意義的基礎上,大體介紹了國內外的研究現狀和筆者的研究思路和方法。第二部分明確研究對象,對核心概念進行界定,并對涉及到的基本理論進行闡述;第三部分將社區(qū)矯正隊伍分為執(zhí)法隊伍和輔助隊伍,通過學歷、教育背景、工作經歷、年齡結構、來源地等對四川省X縣社區(qū)矯正隊伍建設基本情況分別進行分析;第四部分,主要對X縣社區(qū)矯正隊伍建設存在的問題以及存在問題的原因進行深層次的分析;第五部分,在前文分析的基礎上,借鑒國內外相對完備的經驗模式,并結合X縣實際情況,提出對X縣社區(qū)矯正隊伍建設的完善建議:一方面是發(fā)掘現有執(zhí)法人員潛力;另一方面是充分發(fā)揮社會力量參與。
[Abstract]:The establishment of community correction system is a penalty reform based on humanitarianism, which embodies the trend of light punishment and socialization of punishment.Community correction has played an important role in enhancing the efficiency of penalty, reducing the cost of execution, avoiding the cross-infection of prisoners and forming the social personality of prison since the implementation of non-custodial punishment in our country.Community correction work force is gradually formed and play a pivotal role.The effective development of a work force is inseparable from the construction of the work force.At present, the construction mode and management assessment mechanism of the community correction team in our country are still in the initial stage, and are still in the process of continuous exploration and modification in practice. Therefore, the research on the construction of the community correction team will improve the level of community correction work.It is of great significance to stimulate the enthusiasm of community correction workers, to improve the efficiency of community correction work and to standardize law enforcement.With the continuous development of economy and society, the number of community correctional workers will increase gradually, and the quality of community correctional workers will gradually increase.The problems and deficiencies in the construction of community correction team are becoming more and more obvious.Based on the theory of human resource development and public governance, this paper takes X County of Sichuan Province as a case study.The full text is divided into five parts: the introduction part on the basis of the research background and significance of community correction team construction, introduces the domestic and foreign research status quo and author's research ideas and methods.The second part makes clear the research object, defines the core concept, and expounds the basic theory involved. The third part divides the community correction team into law enforcement team and auxiliary team, through education, education background, work experience,Age structure, origin and other basic conditions of community correction team construction in X County of Sichuan Province are analyzed respectively. The fourth part mainly analyzes the existing problems and the causes of the problems in the construction of community correction team in X County.The fifth part, on the basis of the previous analysis, draw lessons from the domestic and foreign relatively complete experience model, and combine the actual situation of X County, put forward some suggestions to improve the construction of community correction team in X County: on the one hand, it is to explore the potential of existing law enforcement personnel;On the other hand, we should give full play to social forces.
