【摘要】： 近年來,未成年人犯罪現(xiàn)象日趨嚴重,犯罪率呈逐年遞增的趨勢,作為國際性的普遍現(xiàn)象,未成年人犯罪與環(huán)境污染、吸毒販毒并稱為世界“三大公害”。對未成年人的保護及預(yù)防犯罪,已經(jīng)成為社會關(guān)注的熱點問題。從未成年人犯罪的現(xiàn)狀及特點來看,未成年人犯罪既有其環(huán)境因素及社會根源,還受主觀因素影響。本文針對未成年人犯罪的現(xiàn)狀,分析了未成年人犯罪的原因,并以此為出發(fā)點,從綜合教育、立法完善、刑事政策等三方面探討未成年人犯罪的防治措施。 本文除引言和結(jié)語外,共分為以下四個部分: 第一部分:未成年人犯罪概述。該部分論述了未成年人犯罪的概念及其界定、中外未成年人犯罪的立法現(xiàn)狀。此部分運用邏輯分析法對未成年人犯罪進行了概述。 第二部分:我國未成年人犯罪的現(xiàn)狀及其發(fā)展趨勢。該部分分別從規(guī)模持續(xù)增大、犯罪低齡化、集團化趨勢明顯、案件惡性加大、犯罪方式智能化、網(wǎng)絡(luò)與未成年人犯罪的關(guān)系等六個方面系統(tǒng)論述了當前我國未成年人犯罪的現(xiàn)狀及其發(fā)展趨勢。 第三部分:未成年人犯罪的原因。該部分從外在和內(nèi)在兩方面綜述了未成年人犯罪的原因:首先結(jié)合家庭、學(xué)校、文化、社會等四大外在環(huán)境因素進行分析,然后再從生理因素、心理因素及行為因素三方面說明未成年人犯罪的內(nèi)在原因。 第四部分:未成年人犯罪的防治措施。該部分是文章的重點,從未成年人犯罪的綜合教育措施、立法完善和刑事政策的完善等三方面入手,基于現(xiàn)有研究成果并結(jié)合現(xiàn)行司法實踐中的有關(guān)內(nèi)容,對未成年人犯罪的防治措施進行詳細的分析研究。
[Abstract]:In recent years, juvenile delinquency is becoming more and more serious, and the crime rate is increasing year by year. As a common international phenomenon, juvenile delinquency and environmental pollution, drug abuse and drug use are regarded as "three public hazards" in the world.The protection of minors and crime prevention has become a hot issue of social concern.Judging from the present situation and characteristics of juvenile delinquency, juvenile delinquency has its environmental factors and social roots, as well as subjective factors.According to the present situation of juvenile delinquency, this paper analyzes the causes of juvenile delinquency, and discusses the prevention and cure measures of juvenile delinquency from three aspects: comprehensive education, legislative perfection and criminal policy.In addition to the introduction and conclusion, this article is divided into the following four parts:The first part: an overview of juvenile delinquency.This part discusses the concept and definition of juvenile delinquency, and the legislative status of juvenile delinquency in China and abroad.This part uses the logic analysis method to carry on the summary to the minor crime.The second part: the present situation and development trend of juvenile delinquency in China.In this part, respectively, the scale continues to increase, the crime age is younger, the trend of collectivization is obvious, the cases become more malignant, and the way of crime is intelligent.This paper systematically discusses the current situation and development trend of juvenile delinquency in China in six aspects, such as the relationship between network and juvenile delinquency.The third part: the causes of juvenile delinquency.This part summarizes the causes of juvenile delinquency from the external and internal aspects: first, combining the family, school, culture, society and other four external environmental factors to analyze, and then from the physiological factors,Psychological factors and behavioral factors explain the internal causes of juvenile delinquency.The fourth part: the prevention and cure measure of juvenile delinquency.This part is the focus of the article, starting with the comprehensive educational measures of juvenile delinquency, the perfection of legislation and the perfection of criminal policy, based on the existing research results and combining with the relevant contents in the current judicial practice,The prevention and control measures for juvenile delinquency are analyzed and studied in detail.
