【摘要】：當(dāng)前，我國(guó)仍然處于社會(huì)主義初級(jí)階段，必須秉持可持續(xù)發(fā)展的理念大力發(fā)展經(jīng)濟(jì)建設(shè)。黨的十七大報(bào)告首次提出建設(shè)生態(tài)文明戰(zhàn)略，到現(xiàn)在我國(guó)的生態(tài)建設(shè)以及由此引發(fā)的產(chǎn)業(yè)結(jié)構(gòu)、增長(zhǎng)模式和消費(fèi)模式的改變已取得了階段性的成果。2012年11月，十八大從新的歷史起點(diǎn)出發(fā)，，強(qiáng)調(diào)“大力推進(jìn)生態(tài)文明建設(shè)”的戰(zhàn)略決策，更是從10個(gè)方面描繪我國(guó)生態(tài)文明建設(shè)的宏偉藍(lán)圖。當(dāng)前，我國(guó)的林業(yè)事業(yè)正在以生態(tài)建設(shè)為核心高速發(fā)展，森林資源持續(xù)增長(zhǎng)，林業(yè)建設(shè)的質(zhì)量和效益逐年提高，有關(guān)林業(yè)的各項(xiàng)工程穩(wěn)步推進(jìn)。與此同時(shí)，以各種利益為出發(fā)點(diǎn)的破壞森林及野生動(dòng)植物資源的違法犯罪活動(dòng)日益增多，嚴(yán)重影響了林業(yè)事業(yè)乃至生態(tài)環(huán)境的有序開發(fā)和合理保護(hù)。 森林公安是維護(hù)我國(guó)林區(qū)社會(huì)治安和保護(hù)森林資源的一支極其重要的刑事執(zhí)法和行政執(zhí)法力量。森林公安作為一支專門保護(hù)森林及野生動(dòng)植物資源、保護(hù)生態(tài)安全、維護(hù)林區(qū)治安秩序的重要力量，應(yīng)當(dāng)在新的歷史機(jī)遇下，認(rèn)真履行職責(zé)，切實(shí)擔(dān)當(dāng)起生態(tài)環(huán)境建設(shè)的橋頭堡作用。 我國(guó)森林公安自1947年組建以來(lái)，充分發(fā)揮保駕護(hù)航作用，積極參與林業(yè)和生態(tài)環(huán)境建設(shè)，忠實(shí)履行職責(zé)，全力保護(hù)森林資源安全和生態(tài)安全，為維護(hù)生態(tài)文明建設(shè)做出了重要的、不可替代的貢獻(xiàn)。但是隨著我國(guó)社會(huì)、經(jīng)濟(jì)和政治的高速發(fā)展，森林公安在管理體制、執(zhí)法地位以及執(zhí)法所依據(jù)的法律法規(guī)的落后與缺失等方面面臨的問(wèn)題日益突出，嚴(yán)重影響著森林公安的發(fā)展，制約著森林公安職能作用的發(fā)揮，也嚴(yán)重威脅到森林資源的保護(hù)和國(guó)家的生態(tài)文明建設(shè)。 本文中，筆者將首先闡述我國(guó)森林公安的概貌；對(duì)于森林公安在履行職責(zé)過(guò)程中存在的種種障礙與尷尬，作者將從森林公安的現(xiàn)行管理體制、執(zhí)法工作現(xiàn)狀、森林防火工作等方面加以分析，總結(jié)出存在的諸多問(wèn)題；然后系統(tǒng)的分析出現(xiàn)這些問(wèn)題的復(fù)雜原因；最后，提出健全森林公安職能、提高森林公安履職能力的構(gòu)想。
[Abstract]:At present, our country is still in the primary stage of socialism, we must vigorously develop economic construction with the concept of sustainable development. The report of the 17th National Congress of the CPC put forward the strategy of building ecological civilization for the first time. By now, the ecological construction of our country and the resulting changes in industrial structure, growth pattern and consumption pattern have achieved some achievements. In November 2012, the 18th National Congress of the National people's Congress set out from a new historical starting point. It is emphasized that the strategic decision of "vigorously promoting the construction of ecological civilization" is a grand blueprint for the construction of ecological civilization in China from 10 aspects. At present, the forestry industry in China is developing at a high speed with ecological construction as the core and the forest resources continue to grow. The quality and efficiency of forestry construction have been improved year by year, and various forestry projects have been advancing steadily. At the same time, illegal and criminal activities aimed at destroying forest and wildlife resources, starting from various interests, are increasing day by day. Has seriously affected the forestry enterprise and even the ecological environment orderly development and the reasonable protection. Forest public security is an extremely important criminal law enforcement and administrative law enforcement force in maintaining social order and protecting forest resources in forest regions of our country. As a special branch of protecting forest and wildlife resources, forest public security protects ecological security. Under the new historical opportunity, the important force of maintaining the order of public order in forest area should perform its duty conscientiously and play the role of bridgehead in the construction of ecological environment. Since its establishment in 1947, China's forest public security has played a full role as escort, actively participated in the construction of forestry and ecological environment, faithfully performed its duties, and made every effort to protect the safety and ecological security of forest resources. It has made an important and irreplaceable contribution to the construction of ecological civilization. But with the rapid development of our society, economy and politics, the forest public security is in the management system. The status of law enforcement and the backwardness and lack of laws and regulations on the basis of law enforcement are increasingly prominent, which seriously affect the development of forest public security and restrict the function of forest public security. It also seriously threatens the protection of forest resources and the construction of national ecological civilization. In this paper, the author will first explain the general picture of the forest public security in our country; for the obstacles and embarrassment existing in the process of carrying out the duties of the forest public security, the author will start with the present management system of the forest public security and the present situation of the enforcement of the law. This paper analyzes the forest fire prevention work and summarizes the existing problems; then systematically analyzes the complex causes of these problems. Finally, it puts forward the idea of perfecting the forest public security function and improving the ability of the forest public security to carry out their duties.
