【摘要】： 檢校聯(lián)手預防高校職務犯罪模式下,檢察機關作為國家專門的法律監(jiān)督機關,不僅擔負起了高校職務犯罪案件的查禁職能,其基于法律監(jiān)督職能開展的職務犯罪預防工作也獨具特色和優(yōu)勢。但從實踐的效果來看,檢察機關的職務犯罪預防工作并未得到高校的普遍認可,檢校預防模式下高校職務犯罪預防工作也未見明顯起色,關鍵在于該模式下職務犯罪預防工作還存在著一系列的問題。正是因為這些問題的客觀存在,影響著高校職務犯罪預防工作的深度、廣度和成效。 文章試以該模式在浙江高校的運用實踐為研究內容,通過探究檢校聯(lián)手預防在整個高校職務犯罪預防體系中的價值和取得的實際經驗,深入闡述檢校聯(lián)手預防模式在高校職務犯罪預防工作中的重要性和必要性。同時,通過對實踐的研究,重點揭示該模式下高校職務犯罪預防工作存在的瓶頸,進一步探討提升高校職務犯罪預防成效的對策。 文章的研究主題是檢校聯(lián)手預防高校職務犯罪的新模式,主要研究兩方面的內容： 第一,檢校聯(lián)手預防在高校職務犯罪預防體系中的價值。 首先分析近年高校職務犯罪的嚴峻形勢和現(xiàn)有高校內部預防上存在的明顯弱勢,由兩者之間的鮮明反差引出對高校權力監(jiān)督體系中的法律監(jiān)督的研究。文章詳細論述了檢察機關的法律監(jiān)督在整個高校權力監(jiān)督體系中的地位以及檢校聯(lián)手模式實施的必要性和可能性,并以檢校聯(lián)手預防模式在浙江高校中的具體實踐為研究內容,分別從教育、制度、懲處三方面深入探究該模式下高校職務犯罪預防工作取得的實際經驗,有力地闡述檢校聯(lián)手預防在高校職務犯罪預防工作中的重要性和必要性。 第二,檢校聯(lián)手模式下,高校職務犯罪預防存在的不足和對策。 同樣以檢校聯(lián)手預防模式在浙江高校中的具體實踐為研究內容,著重從檢校聯(lián)手預防網絡組織的創(chuàng)設、檢察機關預防職務犯罪職權化的法律保障以及高校權力監(jiān)督體系中法律監(jiān)督和黨紀政紀監(jiān)督的關系這三方面入手,對該模式下高校職務犯罪預防工作存在的瓶頸進行深層次地分析,由此有針對性地探討在該模式下,切實提升高校職務犯罪預防工作成效的相應對策。并就確立檢察機關職務犯罪預防職權化的法律保障,將重大項目檢察機關進駐制引入高校職務犯罪預防工作做了重點探討。
[Abstract]:Under the mode of joint prevention of job-related crimes in colleges and universities, procuratorial organs, as special legal supervisory organs of the state, not only undertake the functions of interdiction in cases of job-related crimes in colleges and universities, The prevention of job-related crimes based on the function of legal supervision also has its own characteristics and advantages. However, judging from the effect of practice, the prevention of job-related crimes by procuratorial organs has not been generally recognized by colleges and universities. The prevention of job-related crimes in colleges and universities has not obviously improved, but the key lies in the existence of a series of problems in the prevention of job-related crimes in this mode. It is precisely because of the objective existence of these problems that there are still a series of problems in the prevention of job-related crimes in colleges and universities. It affects the depth, breadth and effect of duty crime prevention in colleges and universities. Based on the application of this model in Zhejiang colleges and universities, this paper attempts to explore the value and practical experience of joint prevention of job-related crimes in the whole system of prevention of job-related crimes in colleges and universities through the exploration of the value and practical experience gained in the prevention system of job-related crimes. In this paper, the importance and necessity of the joint prevention model of procuratorial colleges and universities in the prevention of job-related crimes in colleges and universities are expounded in depth. At the same time, through the study of practice, the bottleneck existing in the prevention of job-related crimes in colleges and universities is revealed. Further probe into the countermeasures to improve the effectiveness of duty crime prevention in colleges and universities. The research theme of this paper is the new mode of prevention of job-related crime in colleges and universities, which mainly focuses on two aspects:. First, the value of joint prevention in the system of duty crime prevention in colleges and universities. First of all, it analyzes the severe situation of duty crime in colleges and universities in recent years and the obvious weakness in the internal prevention of existing colleges and universities. From the sharp contrast between the two, the research on the legal supervision in the power supervision system of colleges and universities is introduced. This paper discusses in detail the position of the legal supervision of procuratorial organs in the whole power supervision system of colleges and universities and the mode of joint inspection and collage. The necessity and possibility of implementation, Taking the concrete practice of the joint prevention model in Zhejiang colleges and universities as the research content, this paper probes into the practical experience gained in the prevention of job-related crimes in the universities from the three aspects of education, system and punishment, respectively. This paper expounds the importance and necessity of joint prevention in the prevention of job-related crimes in colleges and universities. Secondly, the deficiency and countermeasures of duty crime prevention in colleges and universities. In the same way, the concrete practice of the joint prevention model in Zhejiang colleges and universities is taken as the research content, and the establishment of the network organization of joint prevention from the inspection schools is emphasized. The legal guarantee of the procuratorial organ to prevent the duty crime and the relationship between the legal supervision and the party discipline supervision in the power supervision system of the university, This paper makes a deep analysis of the bottleneck existing in the prevention of job-related crimes in colleges and universities under this model, and then probes into the problems in this mode. The corresponding countermeasures to improve the effectiveness of the prevention of job-related crimes in colleges and universities are put forward. The legal guarantee of establishing the functions and powers of the prevention of job-related crimes in procuratorial organs and the introduction of the system of major project procuratorial organs into the prevention of job-related crimes in colleges and universities are discussed emphatically.
