【摘要】：“兩吧一館”即網(wǎng)吧、酒吧和麻將館,是隨著改革開(kāi)放不斷深入,隨著社會(huì)進(jìn)步和人類(lèi)物質(zhì)生活的極大豐富所產(chǎn)生的必然結(jié)果,這類(lèi)場(chǎng)所成為了活躍經(jīng)濟(jì)、豐富群眾業(yè)余文化生活的場(chǎng)所。當(dāng)前,“兩吧一館”在經(jīng)濟(jì)發(fā)展、社會(huì)生活發(fā)面發(fā)揮重要作用的同時(shí),這類(lèi)場(chǎng)所也一直存在容易滋生社會(huì)丑惡現(xiàn)象、引發(fā)治安案件的問(wèn)題,是個(gè)發(fā)案率居高不下,治安混亂的場(chǎng)所,它也一直被較多人質(zhì)疑其存在的價(jià)值和意義,對(duì)此筆者認(rèn)為“兩吧一館”存在就有其合理性和必要性,但是其同時(shí)存在的問(wèn)題也是不容忽視的。當(dāng)前,兩吧一館場(chǎng)所治安混亂,各類(lèi)案件發(fā)案直線上升,涉黃賭毒及暴力案件泛濫,給治理帶來(lái)了一定的難度。筆者通過(guò)走訪調(diào)查群眾和轄區(qū)派出所,采用08、09年公安部門(mén)統(tǒng)計(jì)的發(fā)案數(shù)據(jù),引用當(dāng)?shù)匕讣䦟?shí)例分析,深層次的研究其引發(fā)治安問(wèn)題的根源,發(fā)現(xiàn)在立法上對(duì)于這類(lèi)場(chǎng)所的不健全、政府監(jiān)管不到位、行業(yè)自身規(guī)范不力及執(zhí)法環(huán)境惡劣等原因,我認(rèn)為應(yīng)分析在管理上的難點(diǎn),對(duì)癥下藥,從建立、健全相關(guān)法規(guī),各部門(mén)加強(qiáng)協(xié)作齊抓共管,完善監(jiān)督體系,提高執(zhí)法者素質(zhì)等幾個(gè)方面加強(qiáng)管理,用法律的手段對(duì)“兩吧一館”加強(qiáng)管理和引導(dǎo),使其在健康、有序的軌道上發(fā)展。同時(shí)對(duì)這三種場(chǎng)所的治安狀況進(jìn)行研究,對(duì)于規(guī)范行業(yè)自治、加大監(jiān)督執(zhí)法力度,維護(hù)社會(huì)治安,保障人民群眾安居樂(lè)業(yè),都有著很大的現(xiàn)實(shí)意義。
[Abstract]:The "two bars and one Pavilion", that is, Internet cafes, bars and mahjong houses, are the inevitable result of the continuous deepening of reform and opening up, with social progress and the great enrichment of human material life. Such places have become an active economy. Places to enrich the amateur cultural life of the masses. At present, while the "two bars and one Pavilion" play an important role in economic development and social life, such places have always been prone to breeding social ugliness and causing problems in public order cases. It is a place of high incidence and chaotic public order. It has also been questioned by more people about the value and significance of its existence. In view of this, the author thinks that the existence of "two bars and one Pavilion" has its rationality and necessity. But the problems that exist at the same time are not to be ignored. At present, two bars and one pavilion have chaotic public order, cases of all kinds have risen in a straight line, cases involving pornography, gambling, drugs and violence are rampant. It has brought some difficulties to governance. The author made a deep study of the root causes of public security problems by visiting and investigating the police stations of the masses and districts, using the statistics of the public security departments of 0809, and citing the local case examples to analyze the causes of the public order problems. I found that the legislation for such places is not perfect, the government supervision is not in place, the industry itself is not well regulated, and the law enforcement environment is poor. I think that we should analyze the difficulties in management, prescribe the right medicine, and establish and improve relevant laws and regulations. All departments should strengthen cooperation and joint management, improve the supervision system, improve the quality of law enforcers, and strengthen the management and guidance of the "two bars and one Pavilion" by means of law, so that they can be healthy. At the same time, it is of great practical significance to standardize the autonomy of the industry, to strengthen the supervision and law enforcement, to maintain public order, and to ensure the people to live and work in peace and contentment.
