【摘要】：[目的/意義]研究總體國(guó)家安全觀視角下公共安全情報(bào)法律體系的調(diào)整對(duì)象、基本框架和實(shí)現(xiàn)路徑,對(duì)完善公共安全情報(bào)法律體系具有重要意義。[方法/過(guò)程]從兩個(gè)角度梳理了公共安全情報(bào)的涵義,提出了總體國(guó)家安全觀視角下公共安全情報(bào)的理解,反思了公共安全情報(bào)法律體系建設(shè)中存在的不足,從理論層面論述了總體國(guó)家安全觀視角下公共安全情報(bào)法律體系的優(yōu)化。[結(jié)果/結(jié)論]總體國(guó)家安全觀視角下公共安全情報(bào)法律體系的優(yōu)化,一是要在《國(guó)家安全法》的框架下設(shè)計(jì),二是要樹(shù)立國(guó)家安全與人權(quán)保護(hù)相統(tǒng)一的價(jià)值導(dǎo)向,三是要樹(shù)立國(guó)際視野,四是要形成新的公共安全情報(bào)法律體系框架。
[Abstract]:[purpose / significance] to study the adjustment object, basic framework and realization path of the legal system of public safety information under the perspective of the overall national security concept. It is of great significance to perfect the legal system of public security intelligence. [method / process] this paper combs the meaning of public security intelligence from two angles, and puts forward the understanding of public security information from the perspective of general national security. This paper reflects on the shortcomings in the construction of the legal system of public security information. This paper discusses the optimization of the legal system of public security information from the perspective of the overall national security concept. [results / conclusion] the optimization of the legal system of public security information from the perspective of the overall national security concept. First, it should be designed under the framework of the National Security Law; second, it should establish a unified value orientation of national security and the protection of human rights; third, it should establish an international perspective; and fourth, it should form a new framework for the legal system of public security information.
