【摘要】：改革開放三十年以來,我國(guó)經(jīng)濟(jì)社會(huì)高速發(fā)展,然而各種社會(huì)矛盾卻日漸突出,犯罪率呈上升趨勢(shì),其中農(nóng)村人口占比不斷升高。特別值得注意的是,目前農(nóng)村犯罪呈現(xiàn)出一種整村化的態(tài)勢(shì)。“小偷村”、“詐騙村”、“制毒村”等整村犯罪行為讓人觸目驚心,這給地方政府的管理、司法機(jī)關(guān)的辦案帶來了巨大的壓力。本論文從案例出發(fā),闡述了農(nóng)村整村犯罪的主要表現(xiàn)形式、基本特征和發(fā)展趨勢(shì),接著通過分析形成整村犯罪的各個(gè)因素,厘清其形成機(jī)制,給出相應(yīng)的治理措施。全文主要分為四部分,第一部分綜述了國(guó)內(nèi)外農(nóng)村、農(nóng)民以及群體犯罪的研究狀況,并以此為基礎(chǔ)界定了農(nóng)村整村犯罪的概念;第二部分主要采用個(gè)案分析的方法,重點(diǎn)剖析了博社村、寨下鎮(zhèn)的整村犯罪行為,通過比較兩者的異同得出了整村犯罪的特征;第三部分采用了“犯罪化學(xué)反應(yīng)方程式”理論,從分析整村犯罪的群體、導(dǎo)致犯罪的因素以及犯罪的“催化劑”入手,厘清整村犯罪的形成機(jī)制,為治理提供思路;第四部分針對(duì)形成機(jī)制給出治理建議,即防治整村犯罪最直接的方法就是加強(qiáng)控制,包括加強(qiáng)鄉(xiāng)村治理、加大鄉(xiāng)村警務(wù)投入,或者可以通過長(zhǎng)久且持續(xù)的手段改變導(dǎo)致犯罪的內(nèi)外在因素。
[Abstract]:Since the reform and opening up three decades ago, China's economy and society have developed at a high speed. However, various social contradictions are becoming increasingly prominent, and the crime rate is on the rise, among which the proportion of the rural population has been increasing. At present, there is a trend of village-oriented crime in rural areas. Criminal acts such as "thief village", "fraud village", "drug manufacturing village" and so on are shocking. This gives local government management. The judicial organs' handling of cases has brought great pressure. This paper, starting from the case study, expounds the main forms, basic characteristics and development trends of the whole village crime in rural areas, and then through the analysis of the various factors forming the whole village crime, The paper is divided into four parts. The first part summarizes the research status of rural, peasant and group crime at home and abroad, and defines the concept of the whole village crime in rural areas on the basis of it. The second part mainly uses the case analysis method, mainly analyzes the whole village crime behavior of Boshe village and the village town, obtains the characteristic of the whole village crime by comparing the similarities and differences between the two, and the third part adopts the theory of "criminal chemical reaction equation". Starting with the analysis of the whole village crime group, the factors leading to the crime and the "catalyst" of the crime, this paper clarifies the formation mechanism of the whole village crime, and provides some ideas for governance. That is, the most direct way to prevent and cure the whole village crime is to strengthen the control, including strengthening the rural governance, increasing the rural police investment, or can change the internal and external factors that lead to the crime through long-term and sustained means.
