【摘要】： 毒品犯罪已成為全球性的難題,世界各國(guó)都對(duì)其作了艱苦而持久的斗爭(zhēng),而毒品犯罪并未就此消亡,反而有愈演愈烈之勢(shì)。安徽省西北邊陲的國(guó)家級(jí)貧困縣,全國(guó)第一人口大縣——臨泉縣,周邊分別與河南、安徽兩省的九個(gè)縣(市、區(qū))接壤,這一獨(dú)特的地理環(huán)境,加以種種復(fù)雜的原因,絕跡三十余年的毒品犯罪在80年代死灰復(fù)燃,且迅速蔓延,個(gè)別鄉(xiāng)鎮(zhèn)尤為猖獗,已經(jīng)形成了地下毒品消費(fèi)市場(chǎng)和集散地,成為其他多種犯罪的誘發(fā)源。本文通過(guò)對(duì)臨泉縣32個(gè)鄉(xiāng)鎮(zhèn)毒品犯罪情況進(jìn)行調(diào)查,從臨泉縣公安局、人民法院調(diào)出大量詳實(shí)的案例,結(jié)合近年來(lái)我國(guó)經(jīng)濟(jì)體系改革、經(jīng)濟(jì)發(fā)展現(xiàn)狀,密切關(guān)注毒品發(fā)展的規(guī)律,以犯罪學(xué)為基礎(chǔ),借鑒運(yùn)用了社會(huì)學(xué)、心理學(xué)、行為學(xué)、哲學(xué)的科學(xué)方法,深入系統(tǒng)分析了臨泉縣毒品犯罪這一特定區(qū)域的個(gè)體的和社會(huì)的等原因。過(guò)去我們對(duì)臨泉縣這一特定區(qū)域的毒品犯罪從總體上重視不夠,雖然在打擊處理預(yù)防方面取得了一定成效,但對(duì)臨泉縣毒品犯罪缺乏深入的、系統(tǒng)的、專業(yè)的思考和研究,即使有也是對(duì)某一個(gè)個(gè)案進(jìn)行剖析,不少人認(rèn)為,毒品犯罪在刑事犯罪中的比重不大,不值得深入研究,本文認(rèn)為,這是一個(gè)很大的誤區(qū)。毒品犯罪已經(jīng)對(duì)臨泉縣這一特定區(qū)域的經(jīng)濟(jì)發(fā)展、社會(huì)穩(wěn)定和群眾的身體健康造成了嚴(yán)重的危害。 文章主要介紹了臨泉縣毒品犯罪的基本情況和毒品犯罪的打擊處理情況。近年來(lái),臨泉縣毒情形勢(shì)呈現(xiàn)出案件增多,外流犯罪活動(dòng)突出,販運(yùn)路線錯(cuò)綜、涉及地區(qū)復(fù)雜,團(tuán)伙趨于有組織化,作案手段詭秘,藏毒方式多樣,涉毒區(qū)域擴(kuò)大,“汽球”效應(yīng)明顯等特點(diǎn)。分析了毒品犯罪產(chǎn)生問(wèn)題的原因,如毒品高額利潤(rùn)的驅(qū)使,對(duì)毒品犯罪的嚴(yán)重危害性認(rèn)識(shí)不足等。著重評(píng)析臨泉縣公安局偵破“2008.9.26”公安部毒品目標(biāo)案件和辦理本案的成功經(jīng)驗(yàn)。 在金融危機(jī)下臨泉縣毒品違法犯罪新形勢(shì)做了一定的評(píng)析。由于受國(guó)際毒潮和國(guó)內(nèi)毒品犯罪大氣候的影響,臨泉縣已由過(guò)去的種植罌粟為主,發(fā)展為外流販毒與消費(fèi)并存的縣,毒情趨向嚴(yán)重。在金融危機(jī)下,政治、經(jīng)濟(jì)和社會(huì)領(lǐng)域已發(fā)生重大而深遠(yuǎn)的變化,對(duì)臨泉縣的禁毒工作也將產(chǎn)生深遠(yuǎn)的影響。禁毒工作的不利因素在一定時(shí)期內(nèi)可能會(huì)增多。筆者試對(duì)金融危機(jī)下全縣毒品違法犯罪發(fā)展趨勢(shì)作一些分析,掌握禁毒工作的主動(dòng)權(quán)。 最后,介紹了我對(duì)毒品犯罪的綜合整治的一些看法。擬從情報(bào)信息的角度,運(yùn)用信息論、系統(tǒng)論之認(rèn)識(shí)工具,就如何充分發(fā)揮情報(bào)信息在緝毒偵查工作中的作用發(fā)表粗淺的看法。從廣義角度,緝毒工作可歸于刑事偵查范疇。從公安工作的職能劃分角度,緝毒工作因其偵查客體、偵查手段等方面的特殊性而有別于刑偵、經(jīng)偵和國(guó)內(nèi)安全保衛(wèi)。偵查全程的信息化,是緝毒工作在當(dāng)前實(shí)踐中反映的主要特征。我國(guó)《禁毒法》確定“預(yù)防為主,綜合治理,禁吸、禁販、禁種、禁制并舉”的禁毒方針,堅(jiān)持控制非法供應(yīng)和防止濫用并重,禁止和打擊一切從事毒品違法犯罪活動(dòng)。注重禁毒的綜合治理,《中華人民共和國(guó)禁毒法》規(guī)定“禁毒工作實(shí)行政府統(tǒng)一領(lǐng)導(dǎo)、有關(guān)部門各負(fù)其職,社會(huì)廣泛參與的工作機(jī)制”,也是一項(xiàng)系統(tǒng)工程,專門工作與群眾路線相結(jié)合,各職能部門協(xié)調(diào)配合,實(shí)行綜合治理。臨泉縣要按照《臨泉縣禁毒工作領(lǐng)導(dǎo)責(zé)任制追究暫行辦法》堅(jiān)決獎(jiǎng)懲到位,嚴(yán)格落實(shí)責(zé)任追究制度。
[Abstract]:Drug crime has become a global problem, all countries in the world to make a hard and enduring struggle, and drug-related crimes do not die out, but there is a growing trend in Anhui province. This paper mainly introduces the basic situation of combating drug crimes and drug crimes in the county.
