【摘要】：我國是文明古國,文物數(shù)量多、分布廣、保護難度大。當(dāng)前文物毀損和流失的主要原因不是無法可依,而是有法不依、執(zhí)法不嚴(yán)、違法不究。產(chǎn)生這種現(xiàn)象的體制性原因在于監(jiān)管主體缺位、監(jiān)管手段有限。必須進一步加強文物執(zhí)法力量,才能有效地將文物保護的法律條文轉(zhuǎn)變?yōu)閷嶋H行動。國外文物警察制度、國內(nèi)專業(yè)警察制度的實踐以及我國部分地方文物警察制度的探索,為建構(gòu)具有中國特色的文物警察制度提供了有益的借鑒和寶貴的經(jīng)驗。
[Abstract]:China is an ancient civilized country with a large number of cultural relics, wide distribution, and great difficulty in protecting them. The main reasons for the current destruction and loss of cultural relics are not because they cannot be followed, but because the laws are not obeyed and the laws are not strictly enforced. The institutional reason for this phenomenon lies in the absence of the subject of supervision and the limited means of supervision. It is necessary to further strengthen the law enforcement force of cultural relics. In order to effectively transform the legal provisions of cultural relics protection into practical actions, the practice of foreign cultural relics police systems, the domestic professional police systems and the exploration of some local cultural relics police systems in China, It provides useful reference and valuable experience for the construction of the police system with Chinese characteristics.
