【摘要】： 毒品犯罪是全球性的社會(huì)公害,不僅誘發(fā)大量的違法犯罪活動(dòng),嚴(yán)重影響人類的身心健康和社會(huì)的穩(wěn)定,而且危及國家的安全。受國際毒潮的沖擊和國內(nèi)涉毒的影響,20世紀(jì)70年代末以來,我國毒品犯罪活動(dòng)日趨嚴(yán)重。近年來,我國政府堅(jiān)持“預(yù)防為主,綜合治理,禁種、禁制、禁販、禁吸并舉”的禁毒方針,嚴(yán)厲打擊各類毒品犯罪活動(dòng),取得了顯著成效。但也應(yīng)看到,當(dāng)前我國面臨的毒品形勢依然不容樂觀。 我國邊境地區(qū)作為抵御境外毒品滲透的第一道屏障,做好毒品犯罪防治工作對于做好整個(gè)中國禁毒工作意義重大。為此,筆者結(jié)合工作中積累的數(shù)據(jù)資料,通過實(shí)證研究、比較研究和理論研究等方法,對我國邊境地區(qū)毒品犯罪的現(xiàn)狀、成因和特點(diǎn)進(jìn)行了研究,在對我國與有關(guān)國家禁毒政策進(jìn)行比較分析的基礎(chǔ)上,提出了防治我國邊境地區(qū)毒品犯罪活動(dòng)的對策建議。 本文首先概述了邊境地區(qū)毒品犯罪的含義。列舉了學(xué)術(shù)界關(guān)于毒品犯罪含義的七種具有代表性的觀點(diǎn),并逐個(gè)進(jìn)行了分析評價(jià),闡明了筆者觀點(diǎn)。隨后,引用學(xué)術(shù)界觀點(diǎn),結(jié)合我國實(shí)際,論述了我國邊境地區(qū)所包含的范圍,并由此引出邊境地區(qū)毒品犯罪的含義。 本文第二部分通過大量數(shù)據(jù)、案例分析,論述了我國邊境毒品犯罪的現(xiàn)狀、成因及特點(diǎn)。結(jié)合最新數(shù)據(jù),介紹了“金三角”、“金新月”等境外毒源地對我國的現(xiàn)實(shí)威脅;從西南、西北、東南、東北四個(gè)方向,著重分析了境內(nèi)外毒品的流向及毒品犯罪態(tài)勢;從國際、歷史、經(jīng)濟(jì)、地緣等角度,概括了邊境地區(qū)毒品犯罪的成因;以各類數(shù)據(jù)、案例為依據(jù),結(jié)合公安邊防部門禁毒工作實(shí)際,指出了我國邊境地區(qū)毒品犯罪的五個(gè)主要特點(diǎn)(以走私、販賣、運(yùn)輸毒品罪為主;呈現(xiàn)國際化、組織化、職業(yè)化、智能化;大宗化毒品犯罪相對較多;涉槍毒品犯罪增多;毒品犯罪隱蔽性極強(qiáng))。最后,對未來毒品犯罪的發(fā)展趨勢進(jìn)行了初步的預(yù)測。 本文第三部分通過列舉有關(guān)國家地區(qū)(我國臺(tái)灣地區(qū)、香港特區(qū),美、歐、日)和我國毒品犯罪的防治對策,并進(jìn)行了評述。通過比較分析可以看出,隨著“三個(gè)國際禁毒條約”的影響越來越深遠(yuǎn),各締約國在禁毒問題上形成了廣泛共識,在此基礎(chǔ)上,毒品犯罪防治對策和法律法規(guī)逐漸趨同。 本文第四部分針對我國邊境地區(qū)毒品犯罪特點(diǎn),從公安邊防部門防治毒品犯罪工作實(shí)踐出發(fā),提出了加強(qiáng)堵源截流,加強(qiáng)毒品犯罪情報(bào)信息工作,加強(qiáng)緝毒隊(duì)伍和裝備建設(shè),加強(qiáng)跨警種、跨地區(qū)、跨部門合作,加強(qiáng)打擊毒品犯罪的國際合作,完善毒品犯罪刑事立法的對策建議。
[Abstract]:Drug crime is a global social hazard, which not only induces a large number of illegal and criminal activities, but also seriously affects the physical and mental health of human beings and the stability of society. It also endangers the security of the country. Under the impact of the international drug tide and the domestic drug-related influence, since the end of 70s, our country's drug-related criminal activities have become increasingly serious. In recent years, the Chinese government has insisted on "prevention as the priority, comprehensive management, prohibition of species, and prohibition of drugs." The anti-drug policy of proscribing and smoking together has achieved remarkable results in cracking down on all kinds of drug-related criminal activities, but we should also see that the current drug situation in our country is still not optimistic. As the first barrier to resist the infiltration of foreign drugs, it is of great significance to do a good job of drug crime prevention and control in the border area of our country. Therefore, the author combines the data accumulated in the work and makes an empirical study. By means of comparative research and theoretical research, this paper studies the current situation, causes and characteristics of drug crimes in border areas of China. On the basis of comparative analysis of drug control policies between China and the relevant countries, The countermeasures and suggestions to prevent and cure drug crime in border areas of China are put forward. This paper first outlines the meaning of drug crime in border areas. It enumerates seven representative viewpoints on the meaning of drug crime in academic circles, analyzes and evaluates them one by one, and clarifies the author's viewpoint. Combined with the reality of our country, this paper discusses the scope of the border area of our country, and leads to the meaning of the drug crime in the border area. The second part of this paper discusses the current situation, causes and characteristics of border drug crime in China through a large number of data and case analysis. Combined with the latest data, it introduces the real threat to our country from the "Golden Triangle", "Golden Crescent" and other foreign drug sources. From the four directions of southwest, northwest, southeast and northeast, this paper emphatically analyzes the flow of drugs inside and outside the country and the situation of drug crime; from the international, historical, economic, geographical and other angles, it summarizes the causes of drug crime in border areas; and with various kinds of data, On the basis of the case, the paper points out the five main characteristics of drug crime in border areas of our country: smuggling, trafficking, transporting drugs, internationalizing, organizing, professionalizing and intelligent, combining with the actual situation of drug control in public security frontier department. There are relatively many large-scale drug crimes; the number of drug crimes involving guns is increasing; the concealment of drug crimes is extremely strong. Finally, the development trend of drug crimes in the future is preliminarily forecasted. In the third part of this paper, the author lists and comments on the prevention and cure measures of the countries and regions (Taiwan region, Hong Kong Special Administrative region, USA, Europe, Japan) and our country. With the influence of the three international drug control treaties is more and more far-reaching, the States parties have formed a broad consensus on drug control issues, on this basis, drug crime prevention countermeasures and laws and regulations gradually converge. In view of the characteristics of drug crimes in the border areas of China in 4th, this paper, proceeding from the practice of preventing and controlling drug crimes by the public security frontier defense departments, puts forward that we should strengthen the interception of sources and the flow of drugs, strengthen the information work on drug crimes, and strengthen the construction of anti-drug troops and equipment. Strengthen cross-police, cross-regional, inter-departmental cooperation, strengthen international cooperation to combat drug crimes, improve the criminal legislation of drug crime countermeasures.
