【摘要】： 如今,網(wǎng)絡(luò)犯罪已經(jīng)成為人類不得不嚴(yán)肅面對的重要研究課題。雖然國內(nèi)外有關(guān)網(wǎng)絡(luò)犯罪的研究成果已為數(shù)不少,但截至目前來看,絕大多數(shù)都是基于宏觀和理論層面的研究,而少有微觀的和司法實(shí)踐層面的實(shí)證研究。遍尋有關(guān)網(wǎng)絡(luò)犯罪問題的相關(guān)研究,從城市角度出發(fā)的實(shí)證性研究更是基本屬于尚未開墾的處女地。因此,在網(wǎng)絡(luò)犯罪問題突出的特大城市進(jìn)行網(wǎng)絡(luò)犯罪的實(shí)證研究,之于學(xué)術(shù)研究是有深遠(yuǎn)意義的;另一方面,找出特大城市網(wǎng)絡(luò)犯罪問題的原因所在,對于當(dāng)前全國范圍的網(wǎng)絡(luò)犯罪防控工作更是具有重大意義。 本文通過綜合運(yùn)用社會(huì)學(xué)、法學(xué)、經(jīng)濟(jì)學(xué)、心理學(xué)等多學(xué)科方法,在實(shí)地調(diào)查和個(gè)案收集基礎(chǔ)上,利用數(shù)學(xué)模型下的數(shù)據(jù)分析來研究網(wǎng)絡(luò)犯罪問題。同時(shí),又以網(wǎng)絡(luò)犯罪問題最為突出的特大城市為主要的實(shí)證研究對象,從微觀的、實(shí)踐層面上展開對該類地區(qū)網(wǎng)絡(luò)犯罪問題的解讀,以找出目前特大城市網(wǎng)絡(luò)犯罪的原因所在,為當(dāng)前的網(wǎng)絡(luò)犯罪防控工作提供一些不同的思路和參考意見。 全文共分五章。第一章首先從概念和構(gòu)成要件上對所要研究的特大城市網(wǎng)絡(luò)犯罪的“網(wǎng)絡(luò)犯罪”進(jìn)行了理論界定,認(rèn)為網(wǎng)絡(luò)犯罪是和傳統(tǒng)犯罪同“種”不同“類”的犯罪,其更宜從犯罪學(xué)的角度來研究。目前的網(wǎng)絡(luò)犯罪應(yīng)該是指那些發(fā)生在計(jì)算機(jī)網(wǎng)絡(luò)空間、衛(wèi)星電視網(wǎng)絡(luò)空間、手機(jī)通訊網(wǎng)絡(luò)空間等數(shù)字信息空間中的,涉及空間網(wǎng)絡(luò)的技術(shù)及信息或軟硬件系統(tǒng)安全的,包括刑事犯罪行為、一般性違法行為以及有待被犯罪化的網(wǎng)絡(luò)越軌行為在內(nèi)的行為的總稱。隨后又從犯罪構(gòu)成的四個(gè)方面對網(wǎng)絡(luò)犯罪的特征進(jìn)行了闡述。接下來,第二章在理論層面對特大城市網(wǎng)絡(luò)犯罪闡述了筆者的個(gè)人觀點(diǎn),首先從城市化程度與犯罪率、經(jīng)濟(jì)發(fā)展水平與犯罪特點(diǎn)、特大城市在網(wǎng)絡(luò)犯罪中的角色這三個(gè)方面說明特大城市與網(wǎng)絡(luò)犯罪有著值得關(guān)注的聯(lián)系,其次又談到了網(wǎng)絡(luò)犯罪研究與特大城市網(wǎng)絡(luò)犯罪研究的關(guān)系問題,認(rèn)為兩種研究應(yīng)該是相輔相成、各有側(cè)重的。第三章則以具體的特大城市洛陽市為調(diào)研對象分析了該市的網(wǎng)絡(luò)犯罪特點(diǎn)和犯罪原因,為解構(gòu)特大城市網(wǎng)絡(luò)犯罪罪因系統(tǒng)提供了實(shí)證基礎(chǔ)。第四章又通過對特大城市網(wǎng)絡(luò)犯罪的犯罪決策行為建立數(shù)學(xué)建模,分析了各個(gè)致罪因素的原因力大小及相互的順序關(guān)系,為防控網(wǎng)絡(luò)犯罪工作指明了努力的方向。最后,第五章提出了三項(xiàng)針對性防控建議,即根據(jù)城市類型定位防控重點(diǎn)、建立全國聯(lián)網(wǎng)的網(wǎng)絡(luò)犯罪偵辦系統(tǒng)、增加網(wǎng)絡(luò)警察在總警力中的比例。
[Abstract]:Nowadays, cybercrime has become an important research topic that human beings have to face seriously. Although there have been a lot of research achievements on cybercrime at home and abroad, up to now, most of them are based on macroscopic and theoretical research. However, there are few empirical studies at the micro level and judicial practice level. Looking for relevant research on the problem of cybercrime, the empirical research from the perspective of city belongs to virgin land that has not been reclaimed. Empirical research on cybercrime in mega-cities with outstanding problems of cybercrime is of far-reaching significance to academic research. On the other hand, we should find out the reasons for the problem of cybercrime in mega-cities. For the current national network crime prevention and control work is of great significance. Based on the field investigation and case collection, this paper studies the problem of cybercrime by using the methods of sociology, law, economics, psychology and so on. At the same time, it uses the data analysis under the mathematical model to study the problem of network crime. Taking the megacities with the most prominent network crime problem as the main empirical research object, this paper analyzes the problem of network crime in this area from the micro and practical level, in order to find out the reason of the network crime in the present mega-city. For the current network crime prevention and control work to provide some different ideas and reference. This paper is divided into five chapters. The first chapter defines the cybercrime in the megacities in terms of concept and constitutive elements, and thinks that cybercrime is a kind of "different" crime with traditional crimes. It is more appropriate to study it from the perspective of criminology. At present, cybercrime should refer to those that occur in digital information spaces such as computer cyberspace, satellite television cyberspace, mobile phone communication cyberspace, etc. Involving the security of technology and information or software and hardware systems of space networks, including criminal offences, General illegal acts and acts to be criminalized in the network deviant behavior. Then from the four aspects of the composition of the crime to describe the characteristics of cybercrime. The second chapter expounds the author's personal views on cybercrime in mega-cities at the theoretical level. First of all, it discusses the degree of urbanization and crime rate, the level of economic development and the characteristics of crime. The role of megacities in cybercrime shows that mega-cities are closely related to cybercrime. Secondly, the relationship between the study of cybercrime and the study of cybercrime in mega-cities is also discussed. It is believed that the two studies should complement each other and have their own emphases. The third chapter analyzes the characteristics and causes of cybercrime in Luoyang, a specific megalopolis. It provides an empirical basis for deconstructing the criminal cause system of cybercrime in megacities. Chapter 4th establishes a mathematical model for the criminal decision-making behavior of cybercrime in megacities, and analyzes the magnitude of the causes of each crime and the order of each other. Finally, Chapter 5th puts forward three suggestions for prevention and control, that is, according to the types of cities, the focus of prevention and control is to set up a nationwide network network network crime investigation and handling system. Increase the proportion of network police in the total police force.
