構(gòu)建媒體對(duì)公安機(jī)關(guān)執(zhí)法監(jiān)督的長(zhǎng)效機(jī)制

【摘要】: 2003年是我國(guó)政府實(shí)施政務(wù)信息公開制度的標(biāo)志年,也是公安機(jī)關(guān)重視與媒體關(guān)系的開始之年。長(zhǎng)期以來,公安機(jī)關(guān)在與媒體的交往過程中始終處于強(qiáng)勢(shì)地位,但隨著近年來媒體的迅速發(fā)展使得公安機(jī)關(guān)越來越重視彼此之間的關(guān)系,這也是符合時(shí)代潮流的必然選擇。我國(guó)傳統(tǒng)社會(huì)的政治格局是強(qiáng)國(guó)家弱社會(huì),作為國(guó)家重要暴力機(jī)關(guān)的公安機(jī)關(guān)并沒有把構(gòu)建與媒體良性互動(dòng)的關(guān)系擺上工作日程,媒體在公安機(jī)關(guān)的領(lǐng)導(dǎo)者眼中依然是可以由公安機(jī)關(guān)擺布的對(duì)象,這種慣性思維模式使得兩者的關(guān)系一度處于緊張狀態(tài)。隨著社會(huì)的不斷發(fā)展,我國(guó)現(xiàn)今的媒體早已在數(shù)量和影響力上超越了從前,無(wú)數(shù)的事實(shí)提醒公安機(jī)關(guān)要重新審視與媒體的關(guān)系,要與媒體建立合作共贏、互惠互利的長(zhǎng)效機(jī)制,這也是順應(yīng)時(shí)代的明智舉措。 媒體的高速發(fā)展固然是我國(guó)政府重視媒體關(guān)系的一個(gè)重要緣由,進(jìn)一步分析看來,其深層次原因是我國(guó)民主政治力量發(fā)展的直接推動(dòng)。起始于20世紀(jì)90年代的社會(huì)主義市場(chǎng)經(jīng)濟(jì)體制改革是我國(guó)政治民主化發(fā)展的直接推動(dòng)力量,黨的十六大把發(fā)展社會(huì)主義民主、健全社會(huì)主義法制、建設(shè)社會(huì)主義法治國(guó)家作為我國(guó)全面建設(shè)小康社會(huì)的重要目標(biāo)。政治文明的高速發(fā)展必然改變我國(guó)強(qiáng)國(guó)家弱社會(huì)的傳統(tǒng)政治力量對(duì)比格局,媒體作為社會(huì)力量的重要組成部分,其輿論監(jiān)督、表達(dá)民意、民主參與等政治功能必然得到強(qiáng)化。雖然我國(guó)現(xiàn)在仍然處于社會(huì)主義初級(jí)階段,政治民主體制還不夠完善,公眾依然強(qiáng)烈的感受到了媒體在社會(huì)政治生活中不可替代的價(jià)值和功能。 一個(gè)對(duì)人民負(fù)責(zé),希望贏得公眾良好口碑和信任的政府絕對(duì)不會(huì)忽視媒體的作用。公安機(jī)關(guān)作為政府重要的執(zhí)法部門,必然也要面對(duì)和處理與媒體的關(guān)系問題。由于公安機(jī)關(guān)具有不同于政府其他部門的特殊性,使公安機(jī)關(guān)與媒體的關(guān)系更具有現(xiàn)實(shí)性和緊迫性,主要原因在于: 首先,公安機(jī)關(guān)的工作需要借助媒體的力量了解輿情和引導(dǎo)輿論。公關(guān)機(jī)關(guān)的工作具有社會(huì)性和群眾參與性,其正面形象的宣傳和維護(hù)需要借助媒體的力量,這也是促使公安機(jī)關(guān)重視媒體監(jiān)督的直接原因。 其次,涉及公安機(jī)關(guān)的負(fù)面報(bào)道凸顯了爭(zhēng)取媒體理解和支持的緊迫性。公安機(jī)關(guān)的工作涉及千家萬(wàn)戶的利益,公安機(jī)關(guān)的違法亂紀(jì)事件被媒體看做是有價(jià)值的新聞爭(zhēng)相報(bào)道,這給公安機(jī)關(guān)的形象和工作帶來極大困擾。沉痛的教訓(xùn)使公安機(jī)關(guān)認(rèn)識(shí)到,要善于運(yùn)用與媒體溝通的技巧來化解自身形象危機(jī)事件。 再次,突發(fā)公共安全事件的增加使公安機(jī)關(guān)與媒體的關(guān)系更具張力。公安機(jī)關(guān)在處理突發(fā)公共安全事件的時(shí)候會(huì)習(xí)慣性的保持沉默,而媒體則急切的想要知道與事件有關(guān)的各種信息,這兩種張力會(huì)使公安機(jī)關(guān)在與媒體的互動(dòng)過程中產(chǎn)生摩擦,如何找到信息公開與保密的平衡點(diǎn)顯得尤為重要。 本論文的寫作是在借鑒大量已有研究成果的基礎(chǔ)上完成的,其中不乏有自己新觀點(diǎn)。在當(dāng)代中國(guó)的背景下,公安機(jī)關(guān)和媒體監(jiān)督之間究竟存在怎樣的內(nèi)在關(guān)系,是否有規(guī)律可循?公安機(jī)關(guān)是否可以充分利用這種規(guī)律,同樣建立起一個(gè)普遍存在的應(yīng)對(duì)模式?本文將從普遍規(guī)律的探討入手,旨在為公安機(jī)關(guān)正確對(duì)待新聞媒體的監(jiān)督提出具有建設(shè)性、方向性、指導(dǎo)性的一般法則。全文主要分為六部分: 第一部分:導(dǎo)論;主要介紹論文的選題背景、研究意義、研究方法和創(chuàng)新之處。 第二部分:基本概念的界定與理論基礎(chǔ);主要對(duì)分析公安機(jī)關(guān)與媒體關(guān)系的有關(guān)理論給予介紹和說明,主要包括表達(dá)自由理論、言論自由理論、國(guó)家與社會(huì)關(guān)系理論和博弈理論。 第三部分,國(guó)外經(jīng)驗(yàn)對(duì)我國(guó)公安機(jī)關(guān)的啟示;主要對(duì)英國(guó)和美國(guó)的警方與媒體的關(guān)系予以介紹,目的是為我國(guó)公安機(jī)關(guān)處理與媒體監(jiān)督的關(guān)系提供有效的學(xué)習(xí)和借鑒。 第四部分,我國(guó)公安機(jī)關(guān)與媒體監(jiān)督的關(guān)系現(xiàn)狀和成因;主要對(duì)造成現(xiàn)今公安機(jī)關(guān)與媒體關(guān)系的現(xiàn)狀作出具體分析。 第五部分,構(gòu)建公安機(jī)關(guān)與媒體監(jiān)督良性互動(dòng)的長(zhǎng)效機(jī)制;基于以上分析,對(duì)我國(guó)公安機(jī)關(guān)與媒體監(jiān)督關(guān)系的發(fā)展模式提出具體路徑和措施。 第六部分,參考文獻(xiàn)。
[Abstract]:In 2003 , the public security organs attach great importance to the relationship between the public security organs and the media in the years that the public security organs attach great importance to the media relations . But with the rapid development of the media in recent years , the public security organs are still in tension . With the development of the society , the media has gone beyond the previous and numerous facts . The media has already gone beyond the former and numerous facts in the eyes of the public security organs . The high - speed development of the media is one of the important reasons for our government to attach importance to the media relations . It is further analyzed that the deep reason is the direct impetus of the development of our country ' s democratic political power . The reform of the socialist market economy started in the 1990s is the direct driving force of the development of our country ' s political democratization . The high - speed development of political civilization inevitably changes the traditional political power of the weak society in our country . The media is still in the primary stage of socialism , and the political democracy is not perfect . The public feels strongly and deeply felt the irreplaceable value and function of the media in the social and political life . The public security organs , as the important law enforcement departments of the government , must also face and deal with the relations with the media . As the public security organs have the particularity different from the other departments of the government , the relations between the public security organs and the media are more realistic and urgent , mainly because : First of all , the work of public security organs needs to know the public opinion and guide public opinion by means of the power of the media . The work of the public relations organization has social and public participation , and the propaganda and maintenance of its positive image needs the power of the media , which also causes the public security organ to attach importance to the direct cause of the media supervision . Second , the negative coverage of public security organs highlights the urgency of seeking media understanding and support . The work of public security organs involves the interests of thousands of households , and the violations of the public security organs are reported by the media as valuable news stories , which has caused great trouble to the image and work of the public security organs . The lessons of suffering caused the public security organs to realize that they should be good at using the techniques of communication with the media to resolve their own image crisis events . Thirdly , the increase of public security incidents makes the relations between the public security organs and the media more tension . The public security organs are accustomed to the silence when dealing with sudden public security incidents , and the media are eager to know the various information about the incident , which will cause the public security organs to generate friction in the interaction process with the media , and how to find the balance point of information disclosure and confidentiality . The writing of this thesis is done on the basis of a lot of existing research results , and there is no one ' s new viewpoint . In the context of contemporary China , there is no inherent relationship between the public security organ and the media supervision , whether there is a rule to follow ? Whether the public security organ can make full use of the law , and also establish a common coping mode ? This paper will start with the discussion of the general rule , and aim at providing the general rule of constructive , directional and guiding principles for the public security organ to treat the news media correctly . The whole text is divided into six parts : Part I : Introduction ; mainly introduces the background , significance , research method and innovation of the thesis . The second part : the definition of basic concept and the theoretical basis , mainly introduces and explains the relevant theories of analyzing the relation between public security organs and media , including freedom theory , theory of expression , state and social relation theory and game theory . The third part , the enlightenment of the foreign experience to the public security organs of our country , mainly introduces the relations between the police and the media in the United Kingdom and the United States , and aims at providing effective learning and reference for the relations between the handling of the public security organs and the media supervision in our country . In the fourth part , the relationship between the public security organ and the media supervision is the current situation and the cause , and the present situation of the relationship between the public security organ and the media is analyzed . The fifth part is to construct the long - term mechanism of the benign interaction between the public security organs and the media . Based on the above analysis , the concrete ways and measures are put forward for the development mode of the relations between the public security organs and the media supervision . Part 6 , Ref .
