【摘要】： 隨著我國(guó)經(jīng)濟(jì)的發(fā)展,短短十年間網(wǎng)絡(luò)在我國(guó)從無(wú)到有,經(jīng)歷了迅猛發(fā)展的進(jìn)程。但是,在我國(guó)網(wǎng)絡(luò)迅猛發(fā)展的同時(shí),恰恰由于網(wǎng)絡(luò)科技的發(fā)達(dá),利用技術(shù)手段盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的現(xiàn)象日漸猖獗。因此,對(duì)于這一嚴(yán)重的社會(huì)危害行為的處理不得不提上日程。 本文從分析原因、加強(qiáng)預(yù)防的角度對(duì)盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的行為進(jìn)行闡述。以期能達(dá)到對(duì)這種新型犯罪進(jìn)行規(guī)范的目的。 盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的原因方面,筆者從以下三點(diǎn)進(jìn)行分析,一是盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的道德原因;二是盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的技術(shù)及管理原因;三是盜竊網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪的刑法原因。 提出原因后,根據(jù)原因,筆者提出從以下幾個(gè)方面進(jìn)行預(yù)防,其一是從網(wǎng)絡(luò)自身規(guī)范來(lái)進(jìn)行預(yù)防;其二是利用網(wǎng)絡(luò)技術(shù)手段及管理手段進(jìn)行預(yù)防;其三是從刑法方面進(jìn)行預(yù)防。總體來(lái)說(shuō),希望通過(guò)本文的闡述能對(duì)相關(guān)問(wèn)題做出理論貢獻(xiàn)。
[Abstract]:With the development of our country's economy, the network has gone through the process of rapid development in our country in just ten years. However, with the rapid development of our country's network, it is precisely because of the development of network science and technology. The phenomenon of stealing virtual property by means of technology is rampant day by day. Therefore, the treatment of this serious social harm behavior has to be put on the agenda. From the angle of analyzing the reasons and strengthening the prevention, this paper expounds the behavior of stealing the network virtual property in order to achieve the goal of standardizing this new type of crime. In terms of the causes of the crime of stealing the virtual property on the Internet, the author analyzes the following three aspects: the moral reason of the crime of stealing the virtual property of the network, the reason of the technology and management of the crime of stealing the virtual property of the network; The third is the criminal law reason of the crime of stealing network virtual property. After putting forward the reasons, according to the reasons, the author puts forward the prevention from the following aspects: one is to prevent from the network standard, the other is to use the network technology and management means to prevent; The third is to prevent from the aspect of criminal law. Generally speaking, I hope to make a theoretical contribution to the related problems through the elaboration of this paper.
