【摘要】： 面對日益瘋狂的恐怖犯罪活動,從世界各國的反恐實際情況看,單純從技術層面還沒有能夠普遍適用于各國的防范方案,反恐的根本途徑在于各國的社會綜合治理以及國際合作,其重點在于解決形成恐怖主義基礎的政治、經濟、民族、宗教和社會政策等問題,杜絕安全漏洞。 本文通過分析近年來在世界上發(fā)生的重大恐怖事件和我國鐵路系統(tǒng)面臨的恐怖主義現實威脅,研究我國鐵路防范恐怖主義犯罪的形勢,探討如何采取相關對策、措施,從而穩(wěn)步推進我國鐵路反恐怖斗爭工作,確保運輸生產安全,維護鐵路系統(tǒng)穩(wěn)定,全文分三章進行論述。 第一章內容為恐怖主義犯罪概述。在參照既有學理的基礎上嘗試對恐怖主義犯罪下定義,并對近年來恐怖主義犯罪的動向、特點進行歸納、總結;闡述我國對恐怖主義犯罪的基本立場和反恐立法狀況。 第二章內容為介紹我國鐵路的基本狀況以及作為我國鐵路防范和遏制恐怖主義犯罪的重要專業(yè)力量—鐵路公安機關的現狀及反恐手段和措施,對全國鐵路反恐現狀進行分析、研究;從國際因素、我國周邊情況、我國國內因素、鐵路內部情況等四個方面詳細分析我國鐵路反恐工作面臨的形勢及當前有可能在我國境內對鐵路發(fā)動恐怖襲擊的主要勢力;進一步設想恐怖分子襲擊鐵路可能采取的手段。第三章內容為根據當前我國鐵路反恐工作中存在的主要問題,筆者有針對性地提出加強我國鐵路反恐工作對策、措施,提出切實加強組織領導,落實綜合治理措施,建議在鐵道部公安局增設反恐辦公室,作為常設機構,統(tǒng)一領導全國鐵路反恐工作及徹底理順鐵路查危、巡守工作管理體制;提出進一步嚴密站、車反恐防線,建立反恐長效機制,提升鐵路反恐能力,開展反恐、防火、防爆、防破壞安全大檢查;全面提升防控能力,提高情報信息工作水平、加強鐵路內部安全管理,充分調動職工群眾積極性,完善反恐宣傳機制;加強國際合作,共同打擊恐怖犯罪,借鑒其它國家的經驗教訓、做好應急準備,加快我國鐵路反恐專業(yè)隊伍建設。
[Abstract]:In the face of the increasingly frenzied terrorist criminal activities, from the actual situation of counter-terrorism in the world, there is no universal prevention plan that can be applied to countries from the technical level alone. The fundamental approach to counterterrorism lies in the comprehensive management of societies and international cooperation, with the emphasis on solving the political, economic, ethnic, religious and social policies that form the basis of terrorism and eliminating security loopholes. Based on the analysis of the major terrorist events in the world in recent years and the realistic threat of terrorism in China's railway system, this paper studies the situation of preventing the crime of terrorism in the railway of our country. This paper discusses how to take relevant countermeasures and measures to steadily advance the work of China's railway anti-terrorist struggle, ensure the safety of transportation production, and maintain the stability of the railway system. The full text is divided into three chapters. The first chapter is an overview of terrorist crimes. On the basis of reference to existing theories, it tries to define terrorist crimes, and summarizes the trends and characteristics of terrorist crimes in recent years. This paper expounds our country's basic stand on terrorist crime and the state of anti-terrorism legislation. The second chapter introduces the basic situation of the railway in China and the present situation of railway public security organs as an important professional force to prevent and contain the terrorist crimes. Analyze and study the current situation of railway anti-terrorism in China; From the international factors, China's surrounding situation, China's domestic factors. Four aspects of railway internal situation are analyzed in detail, such as the situation faced by China's railway anti-terrorism work and the main forces that may launch terrorist attacks on railways in China at present; In the third chapter, according to the main problems existing in China's railway anti-terrorism work, the author puts forward countermeasures to strengthen the railway counter-terrorism work in China. Measures should be taken to conscientiously strengthen organizational leadership and implement comprehensive measures of control, and it is proposed to set up a counter-terrorism office in the Ministry of Railways Public Security Bureau as a permanent body to uniformly lead the national railway anti-terrorism work and thoroughly straighten out the danger of the railway. The management system of patrol work; Put forward further tight anti-terror defense line, establish anti-terrorist long-term mechanism, enhance the ability of anti-terror railway, carry out anti-terror, anti-fire, anti-explosion, anti-damage security inspection; Improve the ability of prevention and control, improve the level of intelligence and information work, strengthen the internal safety management of railway, fully arouse the enthusiasm of the staff and workers, and improve the anti-terrorist propaganda mechanism; Strengthen international cooperation, jointly crack down on terrorist crimes, draw lessons from the experience of other countries, prepare for emergencies, and speed up the construction of China's railway counter-terrorism professional team.
