論勞動教養(yǎng)的檢察監(jiān)督

【摘要】: 勞動教養(yǎng)制度自上世紀50年代建立以來,一直發(fā)揮著彌補刑罰缺陷,懲戒、改造不法之徒和保障社會主義經(jīng)濟建設(shè)順利進行的作用。但是,隨著我國依法治國方略的提出和法律制度的完善,勞動教養(yǎng)的問題開始顯現(xiàn),其合法性和公正性開始受到公眾的質(zhì)疑,勞動教養(yǎng)的存廢和變革成為專家學(xué)者爭論的焦點。 本文在對勞動教養(yǎng)發(fā)展歷史的回顧和現(xiàn)實問題的分析的基礎(chǔ)之上,以勞動教養(yǎng)的檢察監(jiān)督為視角,試圖找到一條既能解決勞教的現(xiàn)實問題,又能將其逐步推向合法化的良方。本文分為四個部分,第一部分主要研究勞動教養(yǎng)制度發(fā)展的歷史、基本內(nèi)容、存在的問題以及各方對其存廢的爭議。通過對勞動教養(yǎng)的內(nèi)容、問題的研究,發(fā)現(xiàn)勞動教養(yǎng)從決定作出到相對人的法律救濟都缺乏有效的監(jiān)督,致使行政權(quán)力擴大的問題出現(xiàn)。第二部分通過對勞動教養(yǎng)現(xiàn)實意義的研究,認為勞動教養(yǎng)有其存在的現(xiàn)實合理性,因而當前改革的關(guān)鍵是完善監(jiān)督機制以克服現(xiàn)實中存在的問題。完善勞動教養(yǎng)的監(jiān)督機制既符合權(quán)力制衡、人民主權(quán)、人權(quán)保障三大原則,又是我國國情的需要,更是解決現(xiàn)實問題的需要。第三部分主要分析檢察機關(guān)享有勞動教養(yǎng)監(jiān)督權(quán)的正當性和可行性。通過研究檢察機關(guān)監(jiān)督權(quán)的法律規(guī)定,并對檢察機關(guān)與其他國家機關(guān)進行比較論證了檢察機關(guān)對勞動教養(yǎng)進行監(jiān)督的正當性;通過立法的可行性和檢察機關(guān)的業(yè)務(wù)、實踐經(jīng)驗的分析,認為檢察機關(guān)對勞動教養(yǎng)進行監(jiān)督具有可行性。第四部分,對勞動教養(yǎng)檢察監(jiān)督權(quán)的現(xiàn)狀進行分析,并對其進一步完善提出筆者的建議。筆者主要從勞教檢察監(jiān)督權(quán)的立法、程序、手段等方面提出改革建議,力求通過完善的檢察監(jiān)督克服勞教制度的弊端。
[Abstract]:Since its establishment in -50s, the system of re-education through labor has been playing a role in making up for the penalty defects, punishing, reforming the lawless and ensuring the smooth progress of the socialist economic construction. With the development of the strategy of governing the country according to law and the perfection of the legal system, the problem of reeducation through labor has begun to appear, and its legitimacy and impartiality have been questioned by the public. The retention and reform of reeducation through labor has become the focus of debate among experts and scholars. Based on the review of the history of the development of reeducation through labor and the analysis of practical problems, this paper tries to find a practical problem that can solve the problem of reeducation through labour from the perspective of procuratorial supervision. This paper is divided into four parts. The first part mainly studies the history and basic content of the development of reeducation through labor system. Through the study of the contents and problems of re-education through labor, it is found that there is a lack of effective supervision from the decision to the legal remedy of the relative party. The second part through the study of the practical significance of re-education through labor, think that there is a realistic rationality of the existence of re-education through labor. Therefore, the key to the current reform is to perfect the supervision mechanism to overcome the existing problems in reality, and to perfect the supervision mechanism of re-education through labor conforms to the three principles of power balance, people's sovereignty and human rights protection. The third part mainly analyzes the legitimacy and feasibility of the procuratorial organ to enjoy the supervision right of re-education through labor. By studying the legal provisions of the supervision power of the procuratorial organ. And the procuratorial organs and other state organs to compare and demonstrate the procuratorial organs of the legitimate supervision of re-education through labour; Through the feasibility of legislation, the business of procuratorial organs, practical experience analysis, it is considered that the procuratorial organ supervision of re-education through labor is feasible. Part 4th, the current situation of procuratorial supervision power of re-education through labor is analyzed. The author puts forward the reform suggestions from the aspects of legislation, procedure and means of procuratorial supervision of re-education through labor, and tries to overcome the drawbacks of the system of reeducation through labor through perfect procuratorial supervision.
